Introduction
The State Protection and Guard Service of the Republic of
Moldova is an independent state body, with functions in the field of
national security, specialized in ensuring the protection of Moldovan
dignitaries, foreign dignitaries during their stay in the Republic of
Moldova and their families, within its competence legal. It also
provides security for the headquarters and residences of the above-
mentioned dignitaries.
Article1.1 The State Protection and Guard Service
 The State Protection and Guard Service (hereinafter referred to
as the Service) is a state body with special powers in the field of
state security, specialized in ensuring the protection of
dignitaries of the Republic of Moldova, of foreign dignitaries
during their stay in the Republic of Moldova, of their family
members , within the limits of the legal competences, as well as
in ensuring the security of the workplaces and their residences.
 Performing the service as a protection officer with a special rank
(hereinafter referred to as a protection officer) within the Service
is a special form of public service through which the rights and
obligations of the Service are exercised in the field of state
security.
 The service is subordinate to the President of the Republic of
Moldova.

Article 1.2 Main concepts


 For the purposes of this law, the following main notions
mean:Security measures – all organizational measures, physical
protection, protection and anti-terrorist intervention, protection
in the chemical, biological, radiological and nuclear (CBRN)
field, accompanying and escorting means of transport, security
and access control regime , informational and cyber protection,
investigative, technical-operative, carried out by the Service in
order to fulfill its obligations;
 Protection mission – set of security measures and tests necessary
to ensure the safety of persons receiving state protection;
 Persons receiving state protection – dignitaries of the Republic
of Moldova, foreign dignitaries during their stay in the Republic

 of Moldova, their family members, who are provided with
protection in accordance with this law;
 Workplaces and residences under guard – buildings where the
beneficiaries of state protection work and live, permanently or
temporarily, as well as the related territories;
 Security test – all the actions of examination, verification or
testing of objects (parts, devices, machines, devices,
installations, constructions, transport units) used or intended to
be used by persons receiving state protection, who are carried
out for the purpose of detecting, identifying and removing
explosive devices, firearms, ammunition, blunt or cutting objects
or other dangerous objects, including determining the sanitary-
epidemiological, ecological harmlessness and ionizing radiation
of these objects on the life and health of persons receiving state
protection;
 Protection zone – delimited perimeter, secured with means of
physical and/or technical access control, by marking with
conventional signs that restrict or prohibit access to the given
sector, for the purpose of carrying out protection missions and
ensuring the guarding of the headquarters and residences of the
beneficiaries of state protection.

Article 1.3 Legal framework


 The legal framework of the Service’s activity is the Constitution
of the Republic of Moldova, the State Security Law, the Law on
State Security Bodies, this law, other normative acts, as well as
the international treaties to which the Republic of Moldova is a
party.

Article 1.4 Basic principles


The service operates on the principles of:
a) Legality
b) Equality before the law;
c) Respecting human rights, freedoms and legitimate
interests;
d) Interaction and cooperation;
e) Combining open and secret methods of activity;
f) Personal liabilities;
g) Single leaderships;
h) Impartiality;
i) Control and supervision.

Article 1.5 Cooperation at the national and


international levelLebel
 In order to fulfill its obligations, the Service cooperates with the
Ministry of Internal Affairs, the Intelligence and Security
Service, the Ministry of Defense, the Ministry of Foreign Affairs
and European Integration, with other central and local public
administration authorities, with companies and institutions
having any legal form of organization, with natural persons, as
well as with similar institutions from other countries, including
international profile organizations.
 The institutions provided for in para. 1 , with the exception of
similar institutions from other countries, including relevant
international organizations, are obliged to provide the Service,
within the limits of its legal powers, with the necessary support
to fulfill the obligations provided for by law.

Chapter II
PERSONS BENEFICIARY OF PROTECTION

Article 1.6 Persons receiving state protection.
 Persons receiving state protection: The following are included in
the category of dignitaries of the Republic of Moldova who
benefit from state protection: the President of the Republic of
Moldova, the President of the Parliament and the Prime Minister.
 During the term of office of the President of the Republic of
Moldova, the President of the Parliament and the Prime Minister,
protection is also granted to their family members
(husband/wife, children).
 The President of the Republic of Moldova orders the granting of
protection to other dignitaries or persons and/or their family
members (husband/wife, children), at the written request of the
interested institutions or on their own initiative, if a state of
danger is found or if there is information about the organization
of actions that would threaten their life, physical integrity,
freedom of action and health.
 Outside the national territory, the protection of the dignitaries of
the Republic of Moldova provided for in this law is ensured by
the staff of the Service in cooperation with the special services
with attributions in the field from the host country.
 Foreign dignitaries and their family members
(spouse,childrearprovided with protection during their stay in the
RepubliMoldova in accordance with the national legislation,
with the international treaties to which the Republic of Moldova
is a. State protection in the country of origin. At the writte

 request of the interested institutions, if a state of danger is found
or it.
 threaten their lives, physical integrity, freedom of action and
health, the director of the Service orders the granting of
protection to other foreign dignitaries and their family members
(husband/wife, children), visiting the territory of the Republic of
Moldova, for a period that will not exceed 30 calendar days,
with the information of the President of the Republic of
Moldova.

Article 1.7 Offices, residences


 Offices, residences and objects under guard
The list of workplaces, residences and objects under the
protection of the Service is established by the decree of the
President of the Republic of Moldova.

Chapter III
Managem And Organization Of The Service
Article 1.8 Management of the Service
 The service is led by a director, appointed and dismissed by the
President of the Republic of Moldova.
 The Director of the Service is assisted by 2 deputy directors,
who are appointed and released from office by the President of
the Republic of Moldova, upon the proposal of the Director of
the Service.

 The Director of the Service and his deputies hold positions of
public dignity, obtained by appointment.
 Persons who are prohibited from occupying public positions or
of public dignity, deriving from the findings of the National
Integrity Authority, cannot be appointed to the positions of
director or deputy director of the Service.
 Within the Service, the Service Board is established and
functions, which is an advisory body in the organization of its
activity.
 The Service Board is composed of 11 members. The
composition of the College is approved by the decree of the
President of the Republic of Moldova, upon the proposal of the
director of the Service.
 The meeting of the College is deliberative if at least 2/3 of its
members participate in it. The way of activity of the College is
provided in the internal regulation, which is approved by the
director of the Service.
 The decisions of the College are adopted by the majority vote of
its members. Decisions are recorded and made public by order
of the director of the Service.
Article 1.9 Organization of the Service
 The regulation on the organization and operation of the State
Protection and Guard Service, its structure and personnel limit is
approved by the decree of the President of the Republic of
Moldova, upon the proposal of the director of the Service.
 The service is a legal entity and has a treasury account, a stamp
with the image of the State Coat of Arms of the Republic of
Moldova and corporate symbole.

Article 2.0 Obligations of the Service
The service has the following obligations:
 to prevent, detect and annihilate any action, risk or threat that
would threaten the life, physical integrity, freedom of action and
health of persons receiving state protection, regardless of their
location, to ensure guarding the workplaces and residences of
these persons;
 to undertake the actions provided for in art. 2, necessary to
ensure the security of the persons receiving state protection and
the security of the workplaces and residences of these persons;
 to maintain, within the limits of competence, public order in the
places of permanent or temporary presence of persons benefiting
from state protection and to exclude the causes that prevent the
provision of this order;
 to ensure, independently or in cooperation with other competent
institutions, the accompanying or escorting of the means of
transport with which the persons receiving state protection
move;
 to undertake, within the limits of competence, measures to
ensure the reliability, informational security and operability of
telecommunications systems;
 to organize and coordinate, during the protection missions, the
activity of all participating parties from the institutions provided
for in art. 5 paragraph (1);
 to participate, within the limits of competence, in the fight
against terrorism;
 to undertake, in cooperation with the Intelligence and Security
Service, actions to prevent the leakage of information that is not
intended for publicity;

Article 2.1 Rights of the Service


The Service has the following rights:
 to carry out, in accordance with the legislation, special
investigative activities for the collection, verification and
exploitation of the information necessary to fulfill the
obligations provided for in art. 11 lit. a); to obligatorily
inform, through a notification act, with the submission of
confirmatory materials, other authorities that carry out special
investigative activities about the illegal facts that have become
known that belong to the competence of these authorities;
 to request and receive, in the manner established by the
legislation in force, from public authorities, agencies and
companies from state enterprises and from private enterprises,
as well as from other legal entities, information necessary to
fulfill the obligations of the Service;
 to carry out a special check of the permanent or temporary
places of residence of the persons receiving state protection and
to subject the objects in their use to security tests, using for this
purpose detector dogs and special equipment;
 to detain and hand over to the competent institutions the persons
who commit or have committed illegal acts in the places of
permanent or temporary residence of persons benefiting from
state protection or who intend to enter or who have illegally
entered the areas with prohibited access;
 to submit to public authorities, enterprises, institutions and
organizations proposals for the removal of causes and situations
that endanger the security of persons receiving state protection;

Conclusion
In conclusion, the State Protection and Guard Service is an
institution of major importance in ensuring the security and protection
of important people in Romania. Through its protection, surveillance
and intervention activities, the SPPS contributes to the prevention and
combating of threats to national security and the integrity of protected
persons.
Through the professionalism and dedication of its employees, SPPS
manages to offer a high level of security and protection to those who
benefit from its services. With a modern approach, adapted to
technological developments and new security challenges, SPPS
manages to fulfill its mission in an efficient and responsible way.
In the context of an increasingly complex world and threatened by
various dangers, the role of the State Protection and Guard Service is
becoming increasingly crucial for ensuring stability and security in the
country. Through its activities to prevent risks and protect people
exposed to threats, SPPS contributes to maintaining public order and
the dignity of Romanian state institutions.
