MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement made and executed by and between:

UNIVERSITY OF SAN CARLOS (USC), a corporation duly organized and existing under
the laws of the Republic of the Philippines, with principal office at P. Del Rosario St, Cebu
City, Philippines represented herein by FR. JESURAJ ANTHONIAPPEN, SVD, Vice
President of Academic Affairs, hereinafter referred to as the HIGHER EDUCATION
INSTITUTION (HEI),

and

PIXIE DUST CREATIONS PR & EVENTS, a corporation duly organized and existing
under the laws of the Republic of the Philippines, with principal office at 2nd Floor, Piazza
Elesia, Gov. M. Cuenco Avenue, Talamban, Cebu City herein represented by <NAME
OF LEGAL REPRESENTATIVE, its <Position>, hereinafter referred to as the HOST
TRAINING ESTABLISHMENT (HTE),

and

MARLON MARIUS P. SARAGENA JR , Filipino, of legal age, single and a resident of


Casili Hills, Mandaue City hereafter referred to as the STUDENT TRAINEE.

Witnessed:

The parties hereby bind themselves to undertake a Memorandum of Agreement for


supporting the HEI’s Student Training Program (STP) or Practicum/Work Integrated
Learning for student trainees aimed at developing a globally competitive professional
through actual exposure under the following terms and conditions:

1. The student training program is for a maximum of 600 hours and shall start on
August 2023 and ends on December 2023 broken down as follows:

1.1 560 hours for company exposure; however, work schedule shall in no case less than
four (4) hours and more than eight (8) hours for each practicum day, Monday to Friday, and
shall be agreed upon by and between the STUDENT TRAINEE and the HTE; and

1.2 40 hours allotted for activities organized by the university, college and department
like seminars, conventions and the like, which the STP Coordinators have identified and
agreed upon.

WHEREAS, the HEI offers practicum/work integrated learning subjects or defined as an on-
the-job training for the different programs of the School of Business and Economics under
the Student Training Program with a Coordinator for each department to oversee the
implementation and management of the program and to liaise with the HTEs;

WHEREAS, HEI assigns a faculty adviser for each practicum/work integrated learning
subject who foresees the student’s progress within the company, compliance of the
requirements, and most importantly, the development of the student’s skills and
competences;

WHEREAS, the HTE agrees to receive applicants deemed worthy of the company’s vision
and mission with student’s portfolio, merit and review; and

WHEREAS, the On-the-Job Training program shall be conducted Purely Onsite.

NOW THEREFORE, the HIGHER EDUCATION INSTITUTION (HEI), HOST


TRAINING ESTABLISHMENT (HTE), and STUDENT TRAINEE hereby bind
themselves to undertake this Agreement under the following terms and conditions:

1. The HIGHER EDUCATION INSTITUTION

1.1 shall be responsible for briefing the on-the-job student trainee who intends to conduct
practicum exposure in the HTE as part of the HEI’s curriculum and CHED Memorandum
Order (CMO) No. 23 Series of 2009 and CMO No. 104, Series of 2017;

1.2 shall provide the on-the-job student trainee the basic orientation on work values,
behavior, and discipline to ensure smooth cooperation with the HTE;

1.3 shall guarantee that the STUDENT TRAINEE is adept in the various hardware and
office management software for the use in the discharge of his/her duties;

1.4 shall coordinate with the HTE for effective monitoring of the student training
program;

1.5 shall assign a coordinator/faculty adviser, who will maintain open communication
with and who shall visit the HTE workplace, (HEI and HTE, using their best efforts to set
in advance schedules so as not to disrupt work within the HTE); and

1.6 shall withdraw or pull-out the STUDENT-TRAINEE, who is found to misbehave


and/or act in disobedience to existing standard, rules, regulations of the HEI and HTE and
impose the necessary sanctions against the STUDENT-TRAINEE.

1.6.1 PROVIDED that the terminating party shall formally inform the STP Coordinator of
the grievance before any decision to terminate is made and finalized. The STP Coordinator
shall exert efforts to provide intervention to rectify the situation in the interest of all parties
concern; and

1.6.2 The HEI, HTE and STUDENT TRAINEE shall exert all efforts necessary to
achieve the objectives of this tripartite undertaking.
2 The HOST TRAINING ESTABLISHMENT

2.1 shall commit to take in the STUDENT TRAINEE for the current semester
consistent with the requirements of the HEI, especially in the observance but not limited to
the health protocol requirements for contagious diseases like COVID 19;

2.2 shall assign work to the STUDENT TRAINEE in the areas related to his/her field of
specialization based on the Training Areas provided together with the Endorsement Letter;

2.3 shall provide free relevant instructions and training to the STUDENT TRAINEE,
consistent with its policies, rules and regulations. It shall treat the STUDENT

TRAINEE in a professional manner, and shall not subject him/her to task and work
assignments that are risky, dangerous or unrelated to the purpose of this Agreement;

2.4 shall assign a responsible employee from its workforce who will supervise the work
of the STUDENT TRAINEE and shall maintain open communication with the HEI either
through the STP Coordinator or the Faculty Adviser;

2.5 shall not be required to provide the STUDENT TRAINEE compensation/ benefits
accorded to a regular employee. However, may grant the STUDENT TRAINEE training
allowance, if possible, in accordance with the Company’s existing rules and regulations;

2.6 shall fill out and accomplish the performance evaluation sheet and the attendance
sheet, which will be signed and placed inside a sealed envelope by its responsible employee,
and thereafter be given to the STUDENT TRAINEE for submission to either the STP
coordinator or faculty adviser;

2.7 shall provide a Certificate of Completion to the STUDENT TRAINEE for having
completed the training program; if not, a certification on the number of hours rendered
during the period;

2.8 shall acknowledge and warrant that it does not have an employer-employee
relationship with the STUDENT TRAINEE during the period of the student training
program; and

2.9 shall not be obliged to employ the STUDENT TRAINEE upon completion of the
OJT Program. However, upon consultation with the HEI, may require qualified students to
submit themselves to the Human Resource Department for employment procedures such as
examinations, interviews and submit pertinent documents to support their application.

3 The Parties shall be responsible to ensure that the STUDENT TRAINEE

3.1 shall comply with the provisions of the Agreement at all times and with the rules and
regulations of the HEI and HTE;

3.2 shall keep a work journal and submit weekly reports to the faculty adviser using the
template specified in the STP Manual and on the deadline set by the faculty adviser;

3.3 shall be personally responsible for any and all liabilities arising from gross
negligence in the performance of his/her duties and functions while under training;

3.4 shall maintain confidentiality, when and where appropriate during and after the
training period of all the data, business or trade secrets where such information is not within
the public domain and as indicated and understood as confidential. HTE may require the
STUDENT TRAINEE to sign a non-disclosure agreement;

3.5 shall be evaluated by his/her work supervisor/mentor accordingly based on the


Performance Evaluation specified in the STP Manual and provided by HEI;

3.6 shall fill out evaluations on the practicum experience with the business partner,
practicum program, coordinator and faculty adviser on the deadline set by the STP
coordinator/faculty adviser; and

3.7 shall submit a portfolio at the end of the semester to and on the deadline set by the
faculty adviser and copies of additional company requirements requested of the Work
Supervisor provided with the approval of the latter;

Both the HEI and the HTE shall have the right to pre-terminate this agreement if:

1. The STUDENT TRAINEE violates the rules and regulations of the HTE or for any
serious misconduct on the part of the STUDENT TRAINEE;

2. The HTE does not provide the relevant and responsible training as agreed upon; or

3. There is any violation of the foregoing covenants that will warrant the cancellation of
this Agreement.

EFFECTIVITY/DURATION

This Memorandum of Agreement shall take effect on the date of the signing and shall
continue to be in force for a period of One (1) year unless earlier terminated for just cause,
by either party within thirty (3) days prior written notice to the other party.
