MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (hereinafter referred to as “Agreement”) is


made and entered into by and between:

BATAAN PENINSULA STATE UNIVERSITY is a state university with a principal


address at Capitol Compound, City of Balanga 2100, Bataan, represented by its
University President, DR. RUBY B. SANTOS-MATIBAG, hereinafter referred to as the
“UNIVERSITY”;
- and -

NAME OF HOST TRAINING INDUSTRY (HTI) with office address at Complete


address of HTI herein represented by its Official Representative Name, Position
hereinafter referred to as the “COMPANY”.

WITNESSETH THAT:

WHEREAS, the UNIVERSITY is a duly recognized higher education institution,


that offers Bachelor of Science in Information Technology (BSIT), Bachelor of
Science in Computer Science (BSCS), and Bachelor of Science in Entertainment
and Multimedia Computing (BSEMC) degree programs under the College of
Information and Communications Technology (CICT);

WHEREAS, the curriculum for the BSIT and BSCS degree in the UNIVERSITY is
offering the On-the-Job training program to qualified students who will undergo
industry exposure to form part of the requirements of the program before graduation to
become adequately familiar with the actual industrial operations and management,
thereby augmenting their normal training;

WHEREAS, the COMPANY supports this program of the UNIVERSITY and


agrees to accept and accommodate students, namely; Name of Student1, Name of
Student2..., as trainees in support of its On-the-Job Training Program or OJT (162
hours for BSCS, 324 hours for BSIT and 486 hours for BSEMC per setting) which
aim to forge a strong academe-industry linkage and complement existing course
curricula to match industry demand;

NOW, THEREFORE, for and in consideration of the foregoing premises, the


UNIVERSITY, and the COMPANY do hereby bind themselves to undertake this
Agreement, under the following terms and conditions:

1. The duration of the program shall be equivalent to four hundred eighty-six (486)
hours per OJT site; unless otherwise agreed upon by the COMPANY and the
UNIVERSITY;

2. The UNIVERSITY shall be responsible for briefing the on-the-job student trainees
who intend to conduct practicum exposure in the COMPANY as part of the
University's curriculum;

3. The UNIVERSITY shall provide the on-the-job student trainee basic orientation
on work values, behavior, and discipline to ensure smooth cooperation with the
COMPANY;
4. The UNIVERSITY shall voluntarily withdraw a student-trainee who is found to
have misbehaved and/or acted in defiance of existing standards, rules, and
regulations of the COMPANY and impose necessary sanctions on the said
student-trainees;

5. The COMPANY shall assign personnel who shall orient the student-trainees on
the Rules and Regulations of the COMPANY, especially on such matters that
pertain to safety and security precautions, and who shall supervise and monitor
the activities, performance, and progress of the student-trainees;

6. The COMPANY shall accomplish the necessary form (e.g., Student


Performance Evaluation, etc.) and shall issue a Certificate of Completion to
each student trainee upon fulfillment of all the training requirements;

7. The COMPANY shall provide free relevant instruction and training to the student-
trainees, consistent with its policies, rules, and regulations. It shall professionally
treat the students, and shall not subject him/her to tasks and work assignments
that are risky, dangerous, or unrelated to the purpose of this Agreement;

8. There shall be no employer-employee relationship between the COMPANY and


the student-trainee. As a student-trainee, he/she shall not be entitled to the
compensation/benefits according to an employee.

9. The COMPANY is not obliged to employ the student-trainee upon completion of


training. However, the COMPANY, upon consultation with the UNIVERSITY, may
require qualified students to submit themselves to examinations, and interviews,
and file pertinent documents to support their applications;

10. The student-trainee shall be personally responsible for any liabilities arising from
gross negligence in the performance of his/her duties and functions while under
training;

11. The student-trainee shall not divulge any information that he/she may have
access to, and any such information will only be used for academic purposes;

12. Both parties shall have the right to pre-terminate the OJT if:

a. The TRAINEE violates the rules and regulations of the COMPANY, or


if there is serious misconduct;

b. The COMPANY does not provide the kind of responsible training as


agreed upon; or

c. There is any violation of the foregoing covenants that will warrant the
cancellation of this Agreement;

PROVIDED, that the terminating party shall formally inform the CICT
OJT Coordinator of the grievance before any decision to terminate is
made and finalized. The CICT OJT Coordinator shall intervene to
rectify the situation in the interest of all parties concerned.

13. This MEMORANDUM OF AGREEMENT shall become effective upon signature


of both parties and implementation will begin immediately and shall continue to
be valid hereafter until written notice given by either party, five (5) days before
the date of intended termination.
COMMON PROVISIONS:
1. Any change of training date shall be relayed to the other party at the soonest
possible time by phone and e-mail.

2. The liability of each party under this Agreement is limited to the liability
stipulated herein.

3. This Agreement supersedes and renders void all agreements, written or oral,
before or simultaneously with the signing of this Agreement regarding the
same subject matter.

4. This Agreement shall be valid and effective upon the signing hereof by the
authorized officers until the accomplishment of this Agreement.
