This AGREEMENT for the CONSTRUCTION OF A TWO BEDROOM BUNGALOW HOUSE

made and effective this March 11, 2024, by and between MR. RENE BURDEOS
PALAMOS AND ARLENE FABIA VALENCIA ("OWNER"), and AR. ALVIN KING
MACAALAY, uap ("CONTRACTOR").

OWNER desires to utilize the services of CONTRACTOR for the CONSTRUCTION OF

A TWO BEDROOM BUNGALOW HOUSE, and CONTRACTOR desires to provide his
services to OWNER.

NOW, THEREFORE, in consideration of the mutual promises herein contained, the

parties hereto agree as follows:

Article I Construction Services

OWNER agrees to receive services according to the Article III, and Annex A -
Construction Drawings; and CONTRACTOR agrees to render CONSTRUCTION OF
A TWO BEDROOM BUNGALOW HOUSE to the OWNER.

Article II PLACE OF WORK

The CONSTRUCTION OF A TWO BEDROOM BUNGALOW HOUSE is located at Brgy.

Malabago, Calasiao, Pangasinan.

Article IV Price

The OWNER shall pay the CONTRACTOR in consideration of the full and faithful
performance and accomplishment of all the obligations specified in Article III and
Annex A, which the CONTRACTOR agreed to undertake, perform and accomplish
under this Contract, the contract price of Php. 3,379,000 (Three Million Three
Hundred Seventy Nine Thousand), Philippine Currency, the manner of payment of
which shall be in accordance with Article V. This Total Contract Price is without
prejudice to any adjustments resulting from changes initiated or approved on the
Construction by the OWNER or any changes recommended by the CONTRACTOR
and duly approved by the OWNER.

Article V MANNER OF PAYMENT

The OWNER, upon signing this agreement with the CONTRACTOR, shall make
payment to the CONTRACTOR in the amount of Php 1,000,000.00 (One Million) Php
529,900.00, Philippine Currency

 6.1 PROGRESS PHOTOGRAPHS TO ACCOMPANY REQUEST FOR PAYMENT:
The Contractor at his own expense shall furnish the OWNER progress
photographs which shall be taken twice monthly, starting when the
work begins and continuing so long as the work is in progress.
a. The photographs shall be 6”x8”. At each period four exposures shall
be taken, one on each side of the building. Eight (8) prints dull finish,
(2 copies for each exposure).
b. No partial payment shall be considered without the above
mentioned prints accompanying the Request for Payment.

Article VI Time.
The period of this CONSTRUCTION OF COMMERCIAL BUILDING is from March ____,
2024 to _______, ____, 2024.
7.1 Agreement Time Reckoning
To commence within 7 Days from acknowledgement receipt of payment and
receipt of Notice to Proceed.
Article VII Rendering the Fabrication and Installation
CONTRACTOR shall render the Construction Services according to the Article III
and Annex A - Construction Drawings. CONTRACTOR shall not be liable for any
special, indirect, incidental or consequential damages arising out of or
connected with this AGREEMENT.
Article VIII Fabrication
OWNER shall be responsible for any of CONTRACTOR’s commitments for
fabrication in advance of the time necessary to meet delivery dates.

Article IX Quality Assurance

CONTRACTOR assures that the quality of construction work pursuant to this
Renovation of CONSTRUCTION OF A TWO BEDROOM BUNGALOW HOUSE shall be
of good workmanship, free from defects.
Article X Right of Inspection
OWNER shall have the right to inspect the CONSTRUCTION OF A TWO BEDROOM
BUNGALOW HOUSE. OWNER must give notice to CONTRACTOR of any claim with
respect to the condition, quality or grade of the CONSTRUCTION OF A TWO
BEDROOM BUNGALOW HOUSE or non‐conformance to this AGREEMENT,
specifying the basis of the claim in detail. CONTRACTOR may, at its option, inspect
OWNER’s facilities to confirm that the CONSTRUCTION OF A TWO BEDROOM
BUNGALOW HOUSE do not conform.
Article XI CHANGE ORDERS AND/ OR ADDITIONAL WORKS

The PRINCIPAL may, at anytime, by a written order, make deviations and/or

alterations on the plans and specifications or require additions to the scope of work
required under this Contract. The CONTRACTOR agrees to follow all such deviation and/or
alterations and the provisions of this Contract shall apply to all such changes with the
same force and effect as if they were embodied in the original plans and specifications.
The CONTRACTOR, once given such a written change order, shall immediately study the
effect of such change order on costs and shall inform the PRINCIPAL in writing of any such
increase in costs. The PRINCIPAL shall conform to such increase in costs in writing prior to
CONTRACTOR beginning such work.

 If any such changes or additions cause an increase or decrease in the amount of
work or time required for the performance of this CONTRACT, an equivalent adjustment
shall be made in the total contract cost to be agreed upon by the Parties in writing.
Article XII Making Good of Known Defects
PERIOD OF MAKING GOOD OF KNOWN DEFECTS OR FAULTS: The expression
“Period of Making Good of Known Defects or Faults” shall mean a period after
sixty calendar days, calculated from the date of issue of the Certificate of
Completion of the whole work or of any part thereof, in accordance with Article
XII
Article XIII Substantial Completion
Substantial completion shall mean that the value of the work completed shall not
be less than 98% of the contract amount and that the remaining unfinished work
shall be of a minor nature only.
Article XIV Final Agreement
This AGREEMENT terminates and supersedes all prior understandings or
agreements on the subject matter hereof. This AGREEMENT may be modified
only by a further writing that is duly executed by both parties.
Article XV Headings
Headings used in this AGREEMENT are provided for convenience only and shall
not be used to construe meaning or intent.
