2. Notice is accepted by the learned counsel appearing for the
Respondents, who prays for time to file a response.
3. Let the same be filed within three weeks. Rejoinder two weeks
thereafter. In the meantime, Respondents are directed to decide the

three weeks from today without being influenced by the pendency of the
present petition.
4. Learned Senior Counsel for the Petitioner submits that Petitioner has
certain statutory compliances to be made as also to make payment to the
employees etc. towards salary.
5. Petitioner is permitted to make an application to the Proper Officer,
who shall consider the application in accordance with law to enable the
Petitioner to function as a going concern.
6. Accordingly, it is directed that the representative of the Petitioner
shall appear before the Proper Officer i.e. Mr. Pramod Kumar,
Commissioner, CGST (West), EIL Building, Bhikaji Cama Place, New
Delhi-110066 on 02.04.2024 at 2.30 pm for the said purpose.
7. List on 14.05.2024.
