Directive No. 6
issued pursuant to section 7 of the Public Procurement Act

Responsiveness of Bids

The “Guidelines for the determination of responsiveness of bids”, issued under


Directive 3 as attachment to Circular No. 4 dated 30 April 2010, is hereby amended.

2. Section (iv) (k) of the Guidelines shall now read as follows:

“failure to submit major supporting documents required by the bidding


documents to determine substantial responsiveness of a bid (e.g: (i)
evidence of authorization for the signatory of bid to commit the bidder, unless
the bidder may substantiate during bid clarification that the signatory of the
bid was duly authorized to do so prior to the deadline set for submission of
bids; (ii) evidence of adequacy of working capital if so required in the bidding
document, (iii) proposals for sub-contracting more than a set percentage of
the Contract Price etc..)”.

3. You are kindly requested to bring the contents of this directive to all parties
concerned, especially those called upon to evaluate bids.
