TEACHER

CONTRACT
(SAMPLE: CONTRACT OF EMPLOYMENT)

This Teacher Contract of Employment hereinafter referred to as the “Contract” is duly made, sorted
out, and defined by the undersigned parties to present and contain the employment terms and
conditions of the hired teacher. This Contract is upheld and executed on [SPECIFIC DATE OF
EXECUTION].

The parties to this Contract are as follows:

[SPECIFY NAME OF THE TEACHER] is an individual, of legal age, a citizen of [SPECIFY CITIZENSHIP],
[SPECIFY CIVIL STATUS], and a resident of [SPECIFY PLACE OF RESIDENCE], hereinafter referred to as the
Teacher;

And

[SPECIFY NAME OF THE SCHOOL], is a non-profit corporation which is duly incorporated under the laws
of [SPECIFY STATE OF INCORPORATION] hereinafter referred to as the School.

WHEREAS, this Contract shall be binding to the undersigned parties in its entirety including its incidents
and necessary legal consequences;

WHEREAS, the undersigned Teacher shall provide her professional services to the School for a period of
[SPECIFY CONTRACT TERM] as a [SPECIFY DESIGNATION OF THE TEACHER].

WHEREAS, the School is in need of a Teacher who will share and impart her knowledge and expertise
with regard to [SPECIFY SUBJECT MATTER].

WHEREFORE, the undersigned parties hereby manifest their commitment to adhere and uphold the
terms and conditions of this Contract which are set forth below:

ARTICLE I: ACCEPTANCE

The undersigned Teacher hereby agrees and affirms her acceptance of the offered teaching position at
the undersigned School. The Teacher accepts and commits to be bound by the terms of this
employment contract and execute her duties and responsibilities with due diligence and in good faith.

ARTICLE II: TERM OF EMPLOYMENT


The School requires the undersigned Teacher to provide her professional services for a contract term of
[SPECIFY CONTRACT TERM].

ARTICLE III: SALARY

The School agrees to compensate the undersigned Teacher with a salary of [SPECIFY SALARY]. The
breakdown of the salary package is provided below:

TOTAL USD 00.00

1. The undersigned School agrees to withhold income tax and other government mandated deductions
from the Teacher’s salary in accordance with [SPECIFY LAW].

2. The School shall provide the Teacher with a complete and verified copy of her pay slip every [SPECIFY
DAYS] of the month. The pay slip shall contain the breakdown of the compensation and other
accessory and incidental charges, deductions, and taxes.

3. The management of the School understands and recognizes the fact that there may be instances that
the Teacher may spend her own money or resources for her lessons and other classroom activities. In
line with this, the School commits itself to provide appropriate and reasonable reimbursement to the
resources spent by the undersigned Teacher to be used in the course of performing her duties and
responsibilities, provided that the Teacher complies with the following conditions and requisites:

a. The Teacher must send a written notice or report which provides the details of the planned
activity or program to the School’s management within [SPECIFY NUMBER OF DAYS] days prior to
the scheduled date of the school activity or program.
b. The submitted claim for reimbursement by the Teacher is substantiated by substantial proof and
evidence, including but not limited to receipts and documentation which will be submitted to the
School’s management within [SPECIFY NUMBER OF DAYS] days after the completion of the school
program or activity.
c. The submitted claim adheres to the format or form agreed upon by the undersigned parties, and
is duly submitted by the Teacher to the School.
d. [SPECIFY OTHER AGREED CONDITIONS, IF NECESSARY].
4. Subject to the terms and conditions of this Contract, the undersigned parties duly acknowledge and
affirm that the Teacher will not receive any other consideration or benefits which are beyond the
terms of this Contract.

ARTICLE IV: DUTIES AND RESPONSIBILITIES

The undersigned Teacher is mandated and required by the School to perform and comply with the
following duties and responsibilities:

a. During the Teacher’s contract term, she is mandated to adhere and strictly follow all the rules,
policies, and regulations made by the School’s management with utmost respect and cooperation.

b. The undersigned Teacher must be at all times prepared and responsible in dealing with her students
and in conducting her lectures.

c. The Teacher is required and mandated to present herself in a professional manner to her students.

d. The Teacher shall be teaching [SPECIFY SUBJECT MATTER] to [SPECIFY CLASS OF STUDENTS].

e. The Teacher is required to make a comprehensive teaching plan and curriculum, which shall be
submitted to management before the start of the school year.

f. The Teacher is required to adhere and strictly follow the grading, testing, and student evaluation
system made and implemented by the School.

g. The undersigned Teacher is required to attend and report to any and all seminars, training, and
teacher conferences which the School may prepare and organize.

h. [SPECIFY OTHER DUTIES AND RESPONSIBILITIES OF THE TEACHER]

The undersigned Teacher must understand that the preceding list is not exclusive. The School may from
time to time, as the need arises, delegate and designate to the Teacher additional duties and
responsibilities with prior notice.

The undersigned School is mandated to perform and comply with the following duties and
responsibilities:

a. The School is required to provide adequate training and development opportunities for the Teacher.
b. The School is required and mandated by this Contract to strictly comply with its obligation to pay and
compensate the undersigned Teacher with the agreed compensation package and other benefits
and entitlements.
c. The School shall, at all times, supervise and oversee the performance of the Teacher and give credit
to the Teacher’s quality performance.
d. The School is bound to secure the safety and health of the Teacher within the premises its premises.

ARTICLE V: WORK SCHEDULE

The Teacher’s work schedule is as follows:

Working Days Monday – Friday

Working Hours 7:30 AM – 5 PM

Depending on the directive and needs of the School,


the Teacher may be required to work on special

events and holidays with a corresponding
compensation for that matter.

ARTICLE VI: INSURANCE

1. The School binds itself to provide the undersigned Teacher with a medical insurance, [SPECIFY NAME
OF INSURANCE COMPANY], within the latter’s contract term. The insurance premium will be paid and
shouldered by the School in its entirety.

2. If the Teacher voluntarily or involuntarily pre-terminate the employment contract, the provided
medical insurance shall immediately be severed and terminated by the School.

ARTICLE VII: TRANSPORTATION EXPENSES AND OTHER BENEFITS

1. The undersigned Teacher is entitled to transportation allowance for the amount of [SPECIFY
AMOUNT], which will be provided by the School on a monthly basis.

2. Aside from the transportation allowance, the Teacher is also entitled to the following benefits:
a. Accommodation Benefits
b. Leave Benefits
c. Study or Professional Growth Benefits
d. Family Vacation
e. [SPECIFY OTHER BENEFITS]

ARTICLE VIII: HOLIDAYS

The undersigned School follows and adheres to [SPECIFY STATE] holidays. In the event that the
undersigned Teacher will be required to render work during holidays, holiday premium pay will be
provided accordingly.
ARTICLE IX: WARRANTIES

1. The Teacher warrants the following:

a. That he or she has the knowledge and academic expertise to meet the demands of the School
b. That he or she will perform and comply with his or her tasks in good faith taking into account the
level of diligence required and the standards of quality that he or she needs to suffice
c. That he or she shall perform his or her services in an efficient, prompt, and professional manner

2. The School warrants the following:

a. That it is a legitimate learning and academic institution which is duly registered under the law
b. That the making of this Contract does not in any way go against its Articles of Incorporation

3. The foregoing list of warranties is without prejudice to the list of warranties that are provided and
sanctioned under the law.

ARTICLE X: CODE OF CONDUCT

Herein attached to this Contract is a copy of the School’s code of work ethics and conduct that the
Teacher must strictly follow and comply with at all times.

ARTICLE XI: NON-COMPETITION

The undersigned Teacher must be loyal to the School at all times taking into account the nature of their
relationship. In line with this, the former is expressly prohibited from accepting employment from a
company which is deemed a direct competitor of the undersigned School during the operation of this
Contract and after the termination of this Contract for a period of [SPECIFY PERIOD].

ARTICLE XII: FORCE MAJEURE


Nothing in this Contract makes any of the undersigned parties liable to any form of damage due to force
majeure, including but not restricted to natural debacles, act of government, act of God, and some other
powers and causes that are outside the parties’ ability to control.

If the specified causes meddle in the execution of their individual commitments, the preceding section
shall be operative provided: that there is appropriate notice given to the concerned party within a
period of [SPECIFY NUMBER OF DAYS] days. In any case, this arrangement does not excuse the
performing party from following its commitments upon the termination of the incident.
ARTICLE XIII: GENERAL PROVISIONS

TERMINATION

1. This Contract shall subsist for a period of [SPECIFY PERIOD]. Before the expiration of the terms of this
Contract, any of the undersigned partners may move to terminate the operation of this Contract
provided that the notice requirements are complied with.

2. The undersigned School is entitled and authorized to dismiss the services of the Teacher if any of the
following circumstances occur:

a. If the Teacher commits any breach to the terms and conditions of this Contract
b. If the Teacher grossly neglects and abandons her duties and responsibilities without justifiable
reason
c. If the Teacher commits an act of disloyalty to the School
d. If the Teacher reports to work under the influence of alcohol, illegal drugs, and other prohibited
substances
e. Grounds for termination as provided under the labor law

3. In the event that the undersigned Teacher desires to pre-terminate her contract for personal and
justifiable reasons, the School is duty-bound to compensate the Teacher for the latter’s completed
and rendered services for a period of [SPECIFY AGREED PERIOD] to be reckoned from the submitted
notice to terminate the Contract.

CONFIDENTIALITY

1. The undersigned parties are expressly prohibited from disclosing to third persons or entities who are
not parties to this Contract information and data that are considered as confidential information.
Subject to the terms and conditions of this Contract, confidential information shall mean any
information or data that are deemed private and sensitive in character, and the unauthorized
disclosure of such can pose a grave threat on the goodwill and reputation of one of the undersigned
parties. This information must, at all times, be excluded from the public domain.
2. If a party violates the preceding confidentiality rule, he or she must pay [SPECIFY AMOUNT], as a
form of penalty. This is without prejudice to the right of the party not at fault to pursue legal relief.

3. This provision shall survive and subsist even after the due termination of this Contract.

NOTICE

All exchanges and different types of correspondence between the parties must be in a written
document. The concurred necessities and conditions for a substantial notice are as follows: [SPECIFY

SEVERABILITY

The intention and purpose of the parties of this Contract should consistently be maintained. If any of the
provisions or sections of this Contract are deemed invalid and unenforceable, the legitimacy and validity
of the rest of the provisions in this arrangement should survive and be maintained.

INTERVENTION AND ARBITRATION

Any clash or legally binding debate which may emerge from the implementation of this Contract
concerning the interpretation of particular parts of this Contract and other significant questions that
affect the rights and obligations of the parties, shall be appropriately submitted under the jurisdiction of
the arbitration court. The undersigned parties consented to be guided to the guidelines and rules of
[SPECIFY INSTITUTION].

ASSIGNMENT

This Contract does not vest any of the undersigned parties the privilege to appoint or exchange their
rights and commitments emerging from this Contract to a third-party or entity.

GOVERNING LAW

Over the span of drafting and arranging the terms and conditions of this Contract, the undersigned
parties follow and adhere to [SPECIFY LAW]. Such law is the governing law of the Contract. All legal
questions and doubts that may arise after its implementation must be in resolved in accordance with
such law.

ALTERATIONS

Any of the undersigned parties may seek an amendment or alteration of any part of the terms of this
Contract provided that such request should be initiated within [SPECIFY PERIOD], and the assent and
endorsement of the other party is required. The alteration or amendment must be communicated in a
written document.
WHOLE CONTRACT

This TEACHER CONTRACT is considered the final understanding between the parties which supersedes
all assertions that contradict with the terms and conditions of this Contract. Any earlier agreements
which may significantly clash with this agreement should be considered altered, revoked, and
superseded.

NO IMPLIED WAIVER

If a party neglected to make an express request or exercise a right to demand the performance of a
certain obligation to another party, such act is not equivalent to an implied waiver of such right. It
doesn't preclude or restrict the other party from demanding such obligation from the other party

IN WITNESS WHEREOF, the undersigned parties have completed, perfected, and officially executed this
