Subject: Notice under section 79(3) (B) of IT Act in Complaint of Hon’ble Cabinet Minister Shri
Praksh Javadekar regarding getting multiple emails on his email ID with the subject
name similar to “EIA2020.”

Brief facts of the case: In the above mentioned complaint of Hon’ble Cabinet Minister Shri Praksh
Javadekar regarding the incident of getting multiple emails on his email address with the subject name
similar to “EIA 2020”. After the investigation mainly below mentioned website is sending emails to
him. Their unlawful activities on this website may disturb peace, sovereignty of India.
The concerned websites:--

The actions required:-


1. Block the alleged websites immediately.
2. Record related to this reference may please be preserved.

The above website depicts objectionable contents and unlawful activities or terrorist
act, which are dangerous for the peace, tranquillity and sovereignty of the India. The
publication and transmission of such objectionable contents is a cognizable and punishable
criminal offence under Section 18 of the Unlawful Activities (Prevention) Act.

Now, you being an Internet Service Provider, are thus an intermediary as defined U/S
2(w) of IT ACT , the websites URLs mentioned above are being accessed through your services
and contain religious hatred content/ material, which is punishable U/S 18 of the Unlawful
Activities (Prevention) Act and Information technology Act, 2000 read with Information
Technology (Intermediaries Guidelines) Rules, 2011. Section 18 of the Unlawful Activities
(Prevention) Act reproduced below for ready reference:

Punishment for conspiracy, etc.—Whoever conspires or attempts to commit, or
advocates, abets, advises or incites or knowingly facilitates the commission of, a terrorist act
or any act preparatory to the commission of a terrorist act, shall be punishable with
imprisonment for a term which shall not be less than five years but which may extend to
imprisonment for life, and shall also be liable to fine.
In view of above, you are hereby notified about your services being used for transmission
of unlawful content. It is pertinent to mention that with this notice, the exemption mentioned at
Section 79(1) of IT Act 2000 will not be applicable as per section 79(3) (b) of IT Act, 2000.

It is requested that you may take necessary action (block above said domains/websites)
in this regard and send us a report immediately. Compliance within stipulated period may please
be ensured and the same be communicated to this office.
