Facts of the Case:

As per the FIR registered by Sub-Inspector of P.S. Kotwaliof Patiala District, Punjab on the
basis of the information given by one Virendra Singh who informed that he and Ranvir Singh
were traveling with Gurpreeth Singh in an XUV Car, there was an SUV car, driven negligently
and tried to hit their car. Because of which a dispute arose between Gnana Jyoti Singh and
Gurpreeth Singh at the traffic light of Goal Chowk at about 12.30 p.m. Gnana Jyoti Singh came
out of his car, pulled out the Gurpreeth Singh from his car and inflicted fist blows, which were
so harsh and strong that it grievously hurt him. Suddenly, Virendra Singh and Ranvir Singh
also came out of the car and tried intervening but it aggravated the situation whereas, Gnana
Jyoti Singh's friend, Kuldeep Singh who was in the car also came out and gave a fist blow to
Virendra Singh who got a severe hurt on his face and hand. It was also alleged that the car keys
of Gurpreeth Singh's car were removed by Gnana JyotiSingh and his friend and they fled from
the scene of occurrence. Virendra Singh and Ranvir Singh took Gurpreeth Singh in a rickshaw
to the hospital where the doctors announced that Gurpreeth Singh was brought dead. Apost
mortem was conducted by Dr. Shylesh Kumar who recorded that the injuries were ante-mortem
innature and caused by a blunt weapon though he reserved his opinion on the cause of death
as it could apparently be given only after receiving the FSL report. The FSL report noticed a
large number of abnormalities the condition of the deceased's heart.

Scenerio-1

The police filed the chargesheet under Sec.304 ofIPC against Gnana Jyothi Singh. Aggrieved.
he challenged the chargesheet filed against him.
Scenerio-2

Since Sec.302 was not invoked and also that Kuldeep Singh was not charged, Virendra Singh
filed a PCR againstGnana JyotiSingh and Kuldeep Singh for the offenses punishable under

Sec.302 r/w Sec.34 of IPC. The magistrate directed the police to conduct an investigation and
file a report. The police after investigation filed additional chargesheet including Kuldeep
Aggrieved
Singh as Accused-2, charging him under Sec.304 and also invoking Sec.34 of IPC.
by this Kuldeep Singh filed a petition to quash the charges against him.
The students shall make the memorial on the basis of the above facts.
