CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of Baguio, this day of
November 22, 2023, by and between:

ED CALUAG, of legal age, single/married to JESSICA SOBO, Filipino, and with


residence and postal address at 32-B South Central Aurora Hill, Baguio City, hereinafter referred
to as the OWNER.

-AND-

JUAN DELA CRUZ, Filipino and with residence and postal address at FD 248 Pines Park,
Balili, La Trinidad, Benguet, hereinafter referred to as the RENTER.

WITNESSETH

WHEREAS, the OWNER is the owner of the vehicle being rented described as follows:

WHEREAS, the OWNER agrees to rent out the vehicle to the RENTER.

NOW THEREFORE, for and in consideration of the foregoing premises, the OWNER
leases unto the RENTER and the RENTER hereby accepts from the OWNER the rented
vehicle, subject to the following:

TERMS AND CONDITIONS

1. PURPOSES: That vehicle hereby leased shall be used exclusively by the RENRER for
travel purposes only and shall not be diverted to other uses. If the vehicle is used aside from the
stated purpose, the owner has the right to rescind the contract and the owner reserves the right
raise an action. The RENTER understands that the vehicle is for use only in Manila and cannot
be taken to other locations.

2. TERM: The renter will rent the car from November 24, 2023 at 10:00 am to November 27,
2023 at 5:00pm

3. RENTAL RATE: The renter agrees to pay an an amount of Php 2500 per 24 hours. In case
of cancellation, the downpayment will not be returned if the renter fails to cancel the reservation
within 2 days before the rental date.
4. DEPOSIT: The renter agrees to pay a downpayment amounting to Php 2500 payable prior to
the release of the car.

5. EXCESS HOUR: Use of the vehicle beyond the agreed return time herein shall be subject to
the penalty rate of Php 100 per hour unless the extension has been requested and approved by the
owner.

6. RENTAL EXTENSION: The renter can request for an extension beyond the agreed return
time while the rental is in progress. The renter must specify the extension day but it is only
limited up to 7 days.

Any delay in the return of the vehicle in its current condition (except those normal wear and tear)
to the OWNER on the return date and hour with full tank. The RENTER is also free to run the
vehicle in at 100 km/h.

7. RETURN OF THE VEHICLE: The vehicle shall be return where it was picked up by the
RENTER

8. DAMAGE: In case of damage, the renter shall pay the repair.

9. JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek judicial
relief against the other, the losing party shall pay an amount of One Hundred (100) % of the
amount claimed in the complaint as attorney's fees which shall in no case be less than P50,000.00
pesos in addition to other cost and damages which the said party may be entitled to under the
law.

12. This CONTRACT OF LEASE shall be valid and binding between the parties, their
successors-in-interest and assigns.

IN WITNESS WHEREOF, parties herein affixed their signatures on the date and place
