INSURANCE CLAIM DISPUTE

1. History
11th November 2021- Raju Gandhi renews standard premium
cover insurance for his car Hyundai Elantra. This cover insures
the bearer of claims when damage is done by a third-party.

12th January 2023- During the early hours at around 6 am, the
car collides into a hazard pole. Upon inspection it is revealed
that car has collision damage on the rear bumper as well as
front hood.
It is reported that the region had heavy and dense fog at the
time of collision

13th January- An official FIR is filed and listed at ICICII insurance

claim office for damages.

2. The conflict
Raju Gandhi allegedly was rear ended by a speeding vehicle on
a dense foggy road in Rajendra Nagar which led him to lose
traction and skid off the road into a hazard pole.
 However, FIR investigation states that 2 minors (name withheld)
waiting for their school bus witnessed Raju’s vehicle move in a
zig zag pattern and then eventually collide with a pole. There
was a Red Swift Dzire which went past Raju’s car but didn’t
make any contact reportedly.

Investigation report also states that a short length (not in use)

(road has this 1-meter length divider only) divider has impact
marks at the exact spot where Raju claims to have been rear
ended from the opposite direction. But these cannot be made
clear whether or not are fresh as there are multiple others.
Moreover, Raju’s dashboard camera and witnesses show that
Raju fled immediately after the collision which he cites was
because of medical concerns.
Raju has filed for insurance claim citing damage due to third
party actions.

CCTV footage from a nearby apartment recorded the Red Swift

Dzire car a couple of metres from the spot. Upon reaching out,
the owner told the authorities he didn’t have anything to do
with the collision and the bump was from a couple of months
ago, but there was indeed a bump and it aligned perfectly.

Medical examination report:

Raju had a very minor cut on his arm that wouldn’t otherwise
require medical attention

Raju approached the police after several hours at 9 pm instead

of alerting them immediately.

3. Contact with the Mediation service

The two parties have agreed to approach Abhinn to mediate
the situation
