Case record is taken up for hearing over the bail application filed on
behalf of the accused, Manjit Singh on 05.08.2019 as well as for hearing
over the petition/report filed on behalf of the Ld. A.P.P. on 29.07.2019
praying for extension of the period of investigation.
Heard Ld. Advocate for the accused who pressed for bail contending inter
alia that despite elapse of 180 days prosecution failed to submit report in
final form against
the accused entitling the accused to be released on statutory bail and
therefore accused deserves to be enlarged on statutory bail.
On the other hand Ld. A.P.P. strongly opposed the bail application
contending that though argument advanced by the Ld. Defence Counsel
is, praying for statutory bail but so far as the bail application is concerned
no such bail application was filed praying for statutory bail rather it was
on merit, as it appears from the bail application dated 05.08.2019. Ld.
A.P.P. further submitted that considering the quantity of contraband
which is approximately more than 410.37 kg of ganja and the quantity
involving more than commercial quantity, on the face of sec.37 of the
N.D.P.S. Act accused should not be enlarged on bail.
As regards the prayer for extension of the period of the investigation Ld.
A.P.P. submitted that the prayer was duly filed on 29.07.2019 before the
expiry of 180 days of statutory period and investigation is still pending
and chemical examination report is yet to be obtained by the investigating
agency and more over all the accused have not yet been arrested.
Therefore further extension is required to complete the investigation and
to submit report in final form.
Heard both sides at length. Perused the bail petition filed on behalf of the
accused. Considered.
I find that Ld. A.P.P. is correct that bail has not been pressed on statutory
ground rather on merit bail was sought for. Therefore, considering the
involvement of contraband alleged to have been recovered from the
possession of the accused which is more than commercial quantity, prayer
for bail stands rejected.
After going through the materials in the C.D. and the report of the Ld.
A.P.P. I am satisfied that prosecution needs further time to complete the
investigation and therefore, prayer for extension of the period of
investigation dated 29.07.2019 stands allowed.
Therefore, period of investigation is hereby extended for another 30 days
after expiry of 180 days.
