enrollment pilot programs which expand

access to child care subsidies for working

such county's program and to implement a

plan approved by the office of children

and family services; and up to $385,500

shall be made available to the Consortium
__________________________________________
for
Worker Education, Inc., or other
__________________________________________
designated successor, to administer and to
__________________________________________
implement a plan approved by the office of
__________________________________________
children and family services for
the
__________________________________________
programs in the Liberty Zone, and the
__________________________________________
boroughs of Brooklyn, Queens and Bronx.
__________________________________________
Each pilot program administrator shall
__________________________________________
prepare and submit to the office of chil__________________________________________
dren and family services, the chairs of
__________________________________________
the senate committee on children and fami__________________________________________
lies and the senate committee on social
__________________________________________
services,
the
chair of the assembly
__________________________________________
committee on children and families, the
__________________________________________
chair of the assembly committee on social
__________________________________________
services, the chair of the senate commit__________________________________________
tee on labor, and the chair of the assem__________________________________________
bly committee on labor, an evaluation of
__________________________________________
the pilot with recommendations for contin__________________________________________
uation
or dissolution of the program
__________________________________________
supported by appropriate documentation.
__________________________________________
Such evaluation shall include available,
__________________________________________
information regarding the pilot programs
__________________________________________
or participants in the pilot programs,
__________________________________________
absent identifying information, including
__________________________________________
but not limited to: the number of income__________________________________________
eligible children of working parents with
__________________________________________
income greater than 200 percent but at or
__________________________________________
less than 275 percent of the federal
__________________________________________
poverty level; the ages of the children
__________________________________________
served by the project, the number of fami__________________________________________
lies served by the project who are in
__________________________________________
receipt of family assistance, the factors
__________________________________________
that parents considered when searching for
__________________________________________
child care, the factors that barred the
__________________________________________
families' access to child care assistance
__________________________________________
prior to their enrollment in the pilot
__________________________________________
program,
the
number of families who
__________________________________________
receive a child care subsidy pursuant to
__________________________________________
this program who choose to use such subsi-

exempt provider. Such report shall be

submitted by the applicable project admin__________________________________________
istrator, on or before October 1, 2012,

provided
that if such report is not

received by October 1, 2012, reimbursement
__________________________________________
for administrative costs shall be either
__________________________________________
reduced or withheld, and failure of an
__________________________________________
administrator to submit a timely report
__________________________________________
may jeopardize such program's funding in
__________________________________________
future years.
Expenses related to the
__________________________________________
development of the evaluation of the pilot
__________________________________________
programs shall be paid from the pilot
__________________________________________
program's administrative
set-aside
or
__________________________________________
non-state funds. The remaining portion of
__________________________________________
the project's funds shall be allocated by
__________________________________________
the office of children and family services
__________________________________________
to the local social services districts
__________________________________________
where the recipient families reside as
__________________________________________
determined by the project administrator
__________________________________________
based on projected needs and cost of
__________________________________________
providing child care subsidy payments to
__________________________________________
working families enrolled in the child
__________________________________________
care subsidy program through the pilot
__________________________________________
initiative, provided however that
the
__________________________________________
office of children and family services
__________________________________________
shall not reimburse subsidy payments in
__________________________________________
excess of the amount the subsidy funding
__________________________________________
appropriated herein can support and the
__________________________________________
applicable local social services district
__________________________________________
shall not be required to approve or pay
__________________________________________
for subsidies not funded herein. The total
__________________________________________
number of slots for pilot programs located
__________________________________________
within the city of New York shall not
__________________________________________
exceed one thousand during fiscal year
__________________________________________
2011-2012. Vacancies in child care slots
__________________________________________
may be filled at such time as the total
__________________________________________
enrollment of the New York city pilot
__________________________________________
program is less than one thousand slots.
__________________________________________
The pilot program located in the borough
__________________________________________
of Queens shall receive one new additional
__________________________________________
slot for each slot which becomes available
__________________________________________
through attrition once the total number of
__________________________________________
filled child care slots reaches less than
__________________________________________
one thousand.
Child care subsidies paid
__________________________________________
on behalf of eligible families shall be
__________________________________________
reimbursed at the actual cost of care up
__________________________________________
to the applicable market rate for the
__________________________________________
district
in which the child care is
__________________________________________
provided, for subsidy payments made from
__________________________________________
April 1, 2011 through March 31, 2012 for
__________________________________________
the New York city pilot program and for

subsidy payments made from January 1, 2012

through December 31, 2012 for the Monroe
__________________________________________
county pilot program in accordance with
__________________________________________
the fee schedule of the local social
__________________________________________
services district making
the
subsidy

payments. Pilot programs are required to
__________________________________________
submit monthly reports to the office of
__________________________________________
children and family services, the local
__________________________________________
social services district, and for programs
__________________________________________
located in the city of New York, the
__________________________________________
administration for children's services,
__________________________________________
and the legislature. Each monthly report
__________________________________________
must provide without benefit of personal
__________________________________________
identifying
information,
the
pilot
__________________________________________
program's current enrollment level, amount
__________________________________________
of the child's subsidy, co-payment levels
__________________________________________
and other information
as
needed
or
__________________________________________
required by the office of children and
__________________________________________
family services. Further, the office of
__________________________________________
children and family services shall provide
__________________________________________
technical assistance to the pilot program
__________________________________________
to assist with project administration and
__________________________________________
timely coordination of the monthly claim__________________________________________
ing process. Notwithstanding any other
__________________________________________
provision of law, any pilot programs main__________________________________________
tained herein may be terminated if the
__________________________________________
administrator for such programs mismanages
__________________________________________
such programs, by engaging in actions
__________________________________________
including but not limited to, improper use
__________________________________________
of funds, providing for child care subsi__________________________________________
dies in excess of the amount the subsidy
__________________________________________
funding appropriated herein can support,
__________________________________________
and
failing
to
submit
claims
for
________________________________________________________
reimbursement in a timely fashion ............ 5,460,000

Notwithstanding any inconsistent provision
__________________________________________
of law, the funds appropriated herein
__________________________________________
shall be available to continue operation
__________________________________________
of the
facilitated
enrollment
pilot
__________________________________________
program in Capital Region-Oneida (consist__________________________________________
ing of Rensselaer, Schenectady, Saratoga,
__________________________________________
Albany and Oneida counties) as provided to
__________________________________________
the NYS AFL-CIO Workforce
Development
__________________________________________
Institute to act or continue to act as the
__________________________________________
administrator to implement the program
__________________________________________
proposed by the union child care coalition
__________________________________________
of the NYS AFL-CIO and approved by the
__________________________________________
office of children and family services.
__________________________________________
The administrative cost, including the
__________________________________________
cost of the development of the evaluation
__________________________________________
of the pilot program shall not exceed ten
__________________________________________
percent of the funds available for this
__________________________________________
purpose. The remaining portion of the
__________________________________________
funds shall be allocated by the office of
__________________________________________
children and family services to the local
__________________________________________
social services districts where the recip-

dies paid on behalf of eligible families
__________________________________________
shall be reimbursed at the actual cost of
__________________________________________
care up to the applicable market rate for
__________________________________________
the
district in which child care is
__________________________________________
provided and in accordance with the fee
__________________________________________
schedule of the local social services
__________________________________________
district making the subsidy payment. Up to
__________________________________________
$154,000 shall be made available to the
__________________________________________
NYS AFL-CIO Workforce Development Insti__________________________________________
tute, or other designated administrator,
__________________________________________
to administer and to implement a plan
__________________________________________
approved by the office of children and
__________________________________________
family services for this pilot program in
__________________________________________
consultation with the advisory council.
__________________________________________
This
administrator
shall prepare and
__________________________________________
submit to the office of children and fami__________________________________________
ly services, the chairs of the senate
__________________________________________
committee on social services, the senate
__________________________________________
committee on children and families, the
__________________________________________
senate committee on labor, the chairs of
__________________________________________
the assembly committee on children and
__________________________________________
families, and the assembly committee on
__________________________________________
social services, an evaluation of the
__________________________________________
pilot with recommendations. Such evalu__________________________________________

project is required to submit bi-monthly

reports on the fifteenth day of every
__________________________________________
other month beginning on January 15, 2012
__________________________________________
and bi-monthly thereafter that provide
__________________________________________
current enrollment and information includ__________________________________________
ing, but not limited to, the amount of the
__________________________________________
approved
subsidy level, the level of
__________________________________________
co-payment by the local social services
__________________________________________
district required for the participants in
__________________________________________
the program, the program's adopted budget
__________________________________________
reflecting all expenses including salaries
__________________________________________
and other information as needed, to the
__________________________________________
office of children and family services,
__________________________________________
the chairs of the senate committee on
__________________________________________
social services, the senate committee on
__________________________________________
children and families, the senate commit__________________________________________
tee on labor, the chairs of the assembly
__________________________________________
committee on children and families and the
__________________________________________
assembly committee on social services, and
__________________________________________
the
local
social services districts.
__________________________________________
Provided however that if such bi-monthly
__________________________________________
reports are not received from this Capital
__________________________________________
Region-Oneida administrator, reimbursement
__________________________________________
for administrative costs shall be either
__________________________________________
reduced or withheld and failure of an
__________________________________________
administrator to submit a timely report

without state or local financial partic__________________________________________
ipation, of the career pathways program
__________________________________________
for not-for-profit, community-based organ__________________________________________
izations providing coordinated, comprehen__________________________________________
sive employment services beyond the level
__________________________________________
currently funded by local social services
__________________________________________
districts to eligible individuals
and
__________________________________________
families. Such funds are to be made avail__________________________________________
able
to
establish a career pathways
__________________________________________
program to link education and occupational
__________________________________________
training to subsequent employment through
__________________________________________
a continuum of educational programs and
__________________________________________
integrated support services to
enable
__________________________________________
participants, including disconnected young
__________________________________________
adults, ages sixteen to twenty-four, to
__________________________________________
advance over time both to higher levels of
__________________________________________
education and to higher wage jobs in
__________________________________________
targeted occupational sectors. With funds
__________________________________________
appropriated herein, the office of tempo__________________________________________
rary and disability assistance in consul__________________________________________
tation with the department of labor shall
__________________________________________
establish the career pathways program and
__________________________________________
provide technical support, as needed, to
__________________________________________
provide
education,
training, and job
__________________________________________
placement for low-income individuals, age
__________________________________________
sixteen and older. Preference shall be
__________________________________________
given to eighteen to twenty-four year olds
__________________________________________
who are unemployed or underemployed, in
__________________________________________
areas of the state with demonstrated labor
__________________________________________
market needs and unemployment rates that
__________________________________________
are greater than the
appropriate
or
__________________________________________
comparative rate of employment for the
__________________________________________
region, and to persons in receipt of fami__________________________________________
ly assistance and/or safety net assist__________________________________________
ance. Of the amounts appropriated, at
__________________________________________
least sixty percent shall be available for
__________________________________________
services to eighteen to twenty-four year

temporary and disability assistance in

consultation with the department of labor

shall develop a request for proposals and

shall receive, review, and assess applica__________________________________________
tions. In selecting proposals, the office
__________________________________________
of temporary and disability assistance and
__________________________________________
the department of labor shall give prefer__________________________________________
ence to programs that demonstrate communi__________________________________________
ty-based collaborations with education and
__________________________________________
training providers and employers in the
__________________________________________
region.
Such
education
and training
__________________________________________
providers may include, but not be limited
__________________________________________
to general equivalency diplomas programs,
__________________________________________
community colleges, junior colleges, busi__________________________________________
ness and trade schools, vocational insti__________________________________________
tutions, and institutions with baccalau__________________________________________
reate degree-granting programs; programs
__________________________________________
that provide for a career path or career
__________________________________________
paths, as supported by identified local
__________________________________________
employment needs; programs that provide
__________________________________________
employment services, including but not
__________________________________________
limited
to,
post-secondary
training
__________________________________________
designed to meet the needs of employers in
__________________________________________
the local labor market, or catchment area;
__________________________________________
programs that include education and train__________________________________________
ing components, such as remedial educa__________________________________________
tion, individual training plans, pre-em__________________________________________
ployment training, workplace basic skills,
__________________________________________
and literacy skills training. Such educa__________________________________________
tion and training must include insti__________________________________________
tutions, industry associations, or other
__________________________________________
credentialing bodies for the purpose of
__________________________________________
providing participants with certificates,
__________________________________________
diplomas,
or
degrees;
projects that
__________________________________________
provide comprehensive
student
support
__________________________________________
services, including but not limited to
__________________________________________
tutoring, mentoring, child care, after
__________________________________________
school program access, transportation, and
__________________________________________
case management, as part of the individual
__________________________________________
training plan. Preference shall be given
__________________________________________
to proposals that include not-for-profit
__________________________________________
collaborations with education, training,
__________________________________________
or employer stakeholders in the region;
__________________________________________
programs which leverage additional commu__________________________________________
nity resources and provide participant
__________________________________________
support services; training that result in
__________________________________________
job placement; and education that links
__________________________________________
participants
with
occupational skills

training and/or employer-related creden_________________________________________
