Results of Psychiatric Evaluation
Justin BOURQUE underwent a 28-day court ordered psychiatric

assessment. There is a publication ban on the content of the
assessment. The opinion of the assessing psychiatrist was that Mr.
BOURQUE did not meet the criteria for the defence of not
criminally responsible pursuant to s. 16(1) of the Criminal Code and
further that Mr. Bourque was fit to stand trial.

investigation when his team dropped

on the north side of the same property.

Gail and Caitlyn Kaye were turning on Mailhot
Avenue when they noticed Justin BOURQUE
SUV stopped between them and BOURQUE
BOURQUE steps off the curb, bring up his gun
and shoot between 4 to 7 quick succession shots
in the windshield of the SUV
At 7:48pm, Cst. Ross called on the radio that he
could see Justin BOURQUE and was about to
take him down
Eight (8) seconds later, shots were heard on a
911 call
Cst. Ross fired two rounds through the
windshield of his SUV

Tim Daley, an off-duty firefighter, looked over his fence and saw Justin BOURQUE
Tim noticed the police vehicle stopped approximately 25 feet (7.6 meters) from him. Tim asked
BOURQUE if they should go inside. BOURQUE replied with a firm tone, Probably

He observed Justin BOURQUE
approximately 100 yards ahead of him
BOURQUE had the gun in front of him as if
he was looking for someone to shoot
Wade immediately reversed his vehicle
and backed out on Hildegard Drive
Other witnesses said that BOURQUE
lowered his rifle at a vehicle that turned on
Mailhot Avenue and yelled freeze

SUV
He observed Cst. Ross slumped over in his
seat and unresponsive
When he looked up, he saw Justin

meters) away
BOURQUE started to lower and point his
rifle at him. Cst. White ran to the back of the
SUV

few feet, BOURQUE stopped and lowered

The witnesses saw Cst. Martine Benoit
drive up Hildegard Avenue and approached

from the area when Justin BOURQUE was
shooting at Cst. Martine Benoit
A few witnesses reported that they heard
the whistling of bullets pass by them and
believed the shots were very close to them

Cst. Eric Dubois heard Cst. Martine Benoit on the air saying that she was being shot at
Cst. Dubois drove his police car next to hers for cover, got out of his vehicle and told her to get out
and come to the back of the car with him

At 7:58pm, a little over three (3) minutes after the first volley of shots at Cst. Benoit, BOURQUE
fired again towards the intersection of Mailhot Avenue and Hildegard Drive. This time he was
shooting at Cst. Benoit and Cst. Dubois.

the left side of the road near the fire
station
Stephen heard shots and saw BOURQUE
lying prone on the corner in a grassy area
on the sidewalk

position and walked in a crouched position
for approximately 40 feet (12.2 meters) to
50 feet (15.2 meters) in the ditch area
BOURQUE then walked fast eight to fifteen
feet (2.4 to 4.6 meters) on the sidewalk
before crossing Hildegard Drive

Shortly after leaving his residence, his
family saw Justin BOURQUE walking on the
street in front of their house

At 8:04pm, Cst. Doug Larche arrived at the
intersection of Mailhot Avenue and Isington
Street
He was in plain clothes in an unmarked grey

Nissan Altima. Cst. Larche had a shotgun
and his service pistol. He was also wearing
his body armor
Cst. Larche got out of his car to warn off
civilian on a motorcycle. Cst. Larche told him
to turn around. As Stephane was driving
away, he heard gun shots

Witnesses saw Cst. Larche with his handgun
looking up the sidewalk as though he was
looking for BOURQUE
Sean Rooney called 911 and while on the

phone, he saw Justin BOURQUE walking
between the trees towards the vehicle of
Cst. Larche
Sean observed BOURQUE point his firearm
in the direction of Cst. Larche and fire. Cst.
Larche fired back at BOURQUE, however, did
not hit him
At 8:05pm, shots were reported over the air.

Cst. Michel Martel heard the exchange of
gunfire between Justin BOURQUE and Cst.

The three members felt they had a duty to
protect the civilians and decided to make
their way in that direction
The members crossed Hildegard Drive
using houses and cars for cover as they
made their way south
Cst. Dave Verret came to them with a
police vehicle so they divided in teams of
two and continued south until they came
upon Cst. Larches damaged vehicle
The members kept a perimeter while Cst.
White remained inside with Cst. Larche

1st caller to report that shooter was Justin BOURQUE
At 8:53pm, Adam MacFarlane, a resident 55 Pioneer Avenue,

called to say that the police are looking for Justin BOURQUE.
Adam explained that BOURQUE lived at 13 Pioneer Avenue and
had quite an extensive gun collection.
This was the first time that the name of Justin BOURQUE was
mentioned to the police.

At 9:40pm, Victor BOURQUE called 911 and confirmed his sons identity

Justin BOURQUE was spotted with the Infra-Red Camera
Transport Canada Aircraft:
On June 5th, 2014, at approximately 11:51pm, a
crew member onboard the Transport Canada
aircraft detected a single human heat signature.
Emergency Response Team (ERT):
Using night vision goggles, an ERT member
detected the general area where Justin BOURQUE
was located and called out verbal commands to
Justin BOURQUE, Police, come out with your
hands up! Do it now!. Justin BOURQUE replied
something along the lines of, Ok, I give up, Im
coming out, dont shoot, Im done.
Infra-Red Camera:
On the Infra-Red Camera, BOURQUE was seen
walking towards the police officers, he left behind
two long objects. BOURQUE kept walking towards
the police officers and got into a prone position.
Members then moved towards Justin BOURQUE
and physically restrained him.

Justin BOURQUE was arrested on June 6th, 2014, at 00:10 am
On June 6th, 2014, at 00:10am, Cst. Morrison told Justin BOURQUE that he was under arrest for
murder and gave him the Police Caution and Rights, from memory.
Justin BOURQUE elected to be served in English. Once at the police vehicle, Justin BOURQUE was
explained again that he was under arrest for three counts of murder and two counts of attempted
murder and read the Police Caution and the Rights to Counsel. When asked if he understood,
BOURQUE replied, Ill have to talk to my folks about that, were pretty poor. BOURQUE also
stated,I know how much trouble Im in. BOURQUEs parents were contacted and suggested he
use Legal Aid.
The decision was made to transport Justin BOURQUE to the Sackville RCMP detachment instead of
the Codiac RCMP detachment. Legal Aid was contacted and Justin BOURQUE was provided a
phone call to duty counsel over a cellular phone, in a police vehicle while an officer was holding the
cellular phone.

Justin BOURQUE was booked in a cell with an undercover operator (UC)
Within a short time, BOURQUE said to the UC, as long as this stays between you and me, I
killed 3 cops. The UC said ,right on
BOURQUE bragged about the weapon saying it was M14, full metal jacket. He added that he
would have killed more, however, but for the civilians in the vicinity. BOURQUE stated that he
would not sleep if had he killed civilians
He said, Im not a bad guy; Im just a cop killer. He then said that this makes him a better guy

Warned Statement of Justin BOURQUE
On June 6th, 2014, Justin BOURQUE provided a warned statement to Sgt. Jean-Ren Levesque.
Admission:
BOURQUE admitted to having killed the 3 Police Officers. He also admitted to shooting at others but
described it as suppressive fire because there were civilians in the way. BOURQUE said he told
civilians he would not shoot them and not to worry.
Would have taken more down:
Justin BOURQUE stated that, while he was hiding from police, if police had confronted him he would
have taken more down, depending on how outnumbered he was.

Purchased Legally:
On June 6th, 2014, Justin BOURQUE was arrested while in the possession a M305 rifle which he
purchased on July 24th, 2009, from Better Buy Sports in Moncton, New Brunswick , using a
valid firearm Possession and Acquisition license (PAL)
Prohibited magazines:
The magazine that was in the rifle at the time of BOURQUEs arrest had the capacity to hold
five (5) cartridges
The two other magazines had the capacity to hold twenty (20) cartridges and are prohibited in
Canada
Modifications from semi-automatic to automatic:
The rifle was examined at the RCMP Forensic Laboratory and no alterations or apparent
attempts at alterations were observed to the rifle which would allow it to operate in a full
automatic manner

M305 Rifle
History of firearm:
The M305 is a semi-automatic version of the United States M14 rifle which is currently
prohibited in Canada. Both the M305 and M14 rifles are chambered for a .308 Winchester round
however, the M14 is able to fire in both semi-automatic and fully-automatic modes while the
M305 is manufactured to fire in semi-automatic mode only. The M305, which is sold by both Poly
Technologies and Norinco, is generally sold with a magazine containing 5 rounds or less,
however, there have been numerous issues in the past with overcapacity magazines being sold in
Canada
Ammunition (MFS .308 Win 140 gr SP):
The ammunition used was a Russian made ammunition for .308 Calibre rifles. 140 gr stands for
140 grain bullet and refers to the weight of this projectile. SP refers to Soft Point. The
combination of this cartridge and rifle is typically used for hunting large animals
Effective Range:
With the combination of the rifle and the ammunition, the effect range would be 228.6 meters
(250 yards), however, the environmental factors and the ability of the shooter should be
considered

The Mossberg shotgun is a firearm. Although it was not fired, it was functional

History of firearm:
The Mossberg Shotgun Model 500 is a series of pump-action shotguns manufactured by O.F.
Mossberg & Sons in the United States of America. The 500 is manufactured in several different
gauges. The standard Model holds five 2 shotgun shells in the magazine tube or four 3
shotgun shells in the magazine tube. The magazine tube runs underneath the barrel and allows
for reloading using the manual pump action
Ammunition (12 ga Varmint Express #4 Buckshot)
This 12 gauge ammunition is typically used in shotguns such as the Mossberg Model 500
shotgun, chambered for 12 gauge
Bullet type is a pellet configuration consisting of 24 pellets which are encased inside the
shotgun shell. Pellets are made of a lead composite
This type of shotgun shell is used in hunting of varmint such as coyotes and similar animals. It
also has Law Enforcement and home defence applications

Firearm of Cst. Fabrice Gevaudan:
The service pistol of Cst. Gevaudan was recovered next to him. One (1) bullet was in the
chamber and fourteen (14) in the mag. There was no evidence to support that Cst. Gevaudan
fired his firearm
Trajectory analysis:
Due to the lack of scene evidence, trajectory could only be established for three (3) of the five
(5) fired bullets; two (2) projectiles were fired towards 15 Bromfield Court and at least one (1)
towards the location where Cst. Gevaudan collapsed. However, the autopsy determined that
Cst. Gevaudan sustained 4 gunshot wounds of which two were suspected to have been from the
same bullet. It is believed that the two other fired bullets for which the trajectory could not be
established, reached Cst. Gevaudan near the location where he collapsed
Cause of death:
A forensic autopsy was performed on Cst. Fabrice Gevaudan. His cause of death was determined
to have been gunshot wounds to the chest. Cst. Gevaudan was pronounced deceased at
11:20pm
