SUBJECT : Spot Report on Hacking Incident

DATE : September 25, 2020.

1. REFERENCE: Blotter Entry number 2020-874 dated September 25, 2020.

2. NATURE OF CASE: Frustrated Murder.

3. TIME, DATE AND PLACE OF OCCURRENCE: 3:00 pm of September 25,
2020 at Centro, Purok 2, Brgy. Mapiña, Masbate City.
4. VICTIM: Ricky Barcita y Pablo alias Nonong, 29 years old, married,
construction worker and a resident of Purok 2, Brgy. Mapiña, Masbate City.
5. SUSPECT: Ryan Batasingin y Soler, 32 years old, single with live-in partner,
farmer and a resident of Purok 3, Brgy. Mapiña, Masbate City. (Arrested)

6. FACTS OF THE CASE: At about 6:00 PM of September 25, 2020 Brgy.

Kagawad George Maglente Cinco, 44 years old, married, resident of Purok 2, Brgy.
Mapiña, Masbate City; PMSg Rex C Polinag and PSSg Mark Ian M Guardame both
assigned PCP5 based at Brgy. Bayombon, Masbate City, reported this CPS and
turned-over the said suspect. Initial investigation disclosed that victim while standing
at the side of the river talked to his mother Shirley P Barcita, said suspect arrived and
upon passing at the back of the victim immediately pulled his bolo and hacked the
victim on the head. Upon noticed by the victim that he was hit he jumped to the
middle of the river and he tried to face the suspect but the latter suspect immediately
fled to their house. Responding elements of PCP5 based at Brgy. Bayombon led by
PMSg Rex C Polinag, was able to apprehend the suspect duly informed the cause of
his arrest as well as his constitutional rights under the constitution and brought to
this CPS. Weapon use not recovered. Victim was rushed to Baleno Hospital, Masbate,
for temporary medical treatment thereafter brought to Masbate Provincial Hospital,
Masbate City, for medical treatment. Case for Frustrated Murder is now being
prepared for inquest proceeding.

Ramirez and reported the hacking incident transpired at Centro, Purok 2, Brgy.
Mapiña, Masbate City. Elements of PCP5 Brgy. Bayombon, Masbate City led by PMSg
Alfredo P Ulanday immediately responded and proceeded to the said place to verify the
veracity of the report.

The undersigned complainant, under oath, unto this Honorable Office,
accuses, Ryan Batasingin y Soler, 32 years old, single with live-in partner,
farmer and a resident of Purok 3, Brgy. Mapiña, Masbate City, for Frustrated
Murder committed as follows:
“That on September 25, 2020 at about 3:00 P.M at Centro, Purok
2, Brgy. Mapiña, City of Masbate, Province of Masbate, Philippines, and
within the jurisdiction of this Honorable Office, the above-named
accused with treachery and intent to kill while armed of Bolo did then
and there willfully, unlawfully and feloniously, attack, assault and
hacked one RICKY BARCITA y PABLO hitting head that cause of wound
and injuries, thus performing all the acts of execution which would
produce the crime of Murder but which did not by reason that the victim
was able to run and the timely medical assistance given to him which
prevented his death, to the damage and prejudice of the victim”.

JOINT AFFIDAVIT OF ARREST

We, PMSg Rex C Polinag, legal age, single, PNP member and PSSg Mark
Ian M Guardame, legal age, single, PNP member both assigned at PCP5, Brgy.
Bayombon, Masbate City, after having been duly sworn to an oath in
accordance with the law do hereby depose and say that:

That while we were on duty at PCP5, Brgy. Bayombon, Masbate City,

PMSg Alfredo P Ulanday, our Detachment Commander received phone call from
Kagawad Aragona and Brgy. Secretary Hilda Ramirez informed us that at
around 3:00 PM of September 25, 2020, there was a hacking incident at
Centro, Purok 2, Brgy. Mapiña, Masbate City, perpetrated by one (1) Ryan
Batasingin y Soler;

That upon receipt of the information we immediately proceeded to said

place led by me (PMSg Polinag) and PMSg Ulanday to verify the report;

That while we were at Centro, Purok 2, Brgy. Mapiña, Masbate City,

Brgy. Kagawad George Cinco pointed the house of the suspect Ryan Batasingin
y Soler but when we reached the house said suspect was not there;

That, in a moment Brgy. Kagawad Carlito Cinco guide us toward the little
upper portion of the mountain therein suspect was able to apprehend duly
informed the cause of his arrest as well as his constitutional rights under the
constitution;

That we brought him to Masbate City Police Station and undergone

mandatory medical examination and physical examination at Masbate
Provincial Hospital, Masbate City;

That other details of our apprehension will elaborate in court when called
to testify;

That affiants sayeth none.

mama (Shirley P Barcita) ang sabon at habang nag uusap kami tungkol sa pag
apply ko ng trabaho sa Baleno, Masbate, may taong nag lalakad at papunta sa
aming direksyon na si Ryan Batasingin;

Na ng makarating sa amin ito ay dumaan sa likod ko at sumigaw si

mama sa akin “NONG SUNDANG” at napalingon ako ng kaunti sa likod ko
subalit may tumama sa ulo ko at ako ay tumalon sa gitna ng ilog at nakita ko
si Ryan Batasingin na may hawak na mahabang sundang o bolo at
narandaman ko na may sugat ang ulo ko, napa takbo ako at sinubukan ko
siya na harapin subalit siya ay tumakbo;

Na agad kami nag report sa Brgy. Officials ng Brgy. Mapiña, Masbate at

kaagad ako dinala sa pagamutan ng Baleno, Masbate at dinala sa Masbate
Provincial Hospital, Masbate City;

Na ang ibang detalye ay aking ilalahad pag ako ay tinawag ng korte para
tumestigo;

Na ako ay wala ng ibang sasabihin.

ng anak kung si Ricky Barcita sa may ilog tungkol sa pag apply niya ng
trabaho sa Baleno, Masbate, may nakita kaming taong nag lalakad at papunta
sa aming direksyon ito ay nakilala ko na si Ryan Batasingin;

Na ng makarating sa amin ito ay dumaan sa likod ng anak ko at bigla

itong bumunot ng mahabang “sundang” o bolo at hahampasin sa ulo ang anak
ko sinigawan ko ang anak ko “NONG SUNDANG” subalit tinama ang anak ko
sa ulo at sinigawan ko ang anak ko “NONG TAKBO” kaagad naman tumalon
ang anak ko sa tubig at tumakbo at sinigawan ko ang suspek bakit Ryan kay
tinaga mo ang anak ko;

Na kaagad naman ito tumakbo palayo sa amin;

7. At about 3:10 in the afternoon of September 25, 2020 PMSg
Alfredo P Ulanday, received a cellular phone call of Brgy. Kagawad Aragona and
Brgy. Secretary Hilda Ramirez that there was a hacking incident transpired at
Centro, Purok 2, Brgy. Mapiña, Masbate City and they proceeded to said place.

8. At about 6:00 PM of September 25, 2020 Brgy. Kagawad George
M Cinco, PMSg Rex C Polinag and PSSg Mark Ian M Guardame reported this
CPS and turned-over one Ryan Batasingin y Soler, a suspect in a hacking
incident transpired at about 3:00 pm of September 25, 2020 at Centro, Purok
2, Brgy. Mapiña, Masbate City, wherein a victim Ricky Barcita y Pablo alias
Nonong was hit on the head. (Blotter excerpt hereto attached as Annexed
“B”).
9. In a sinumpaang salaysay executed by Ricky P Barcita disclosed
that he was hacked by the suspect upon passing behind him (Affidavit hereto
attached as Annexed “C”)
10. In a sinumpaang salaysay executed by Shirley P Barcita
disclosed that while they were talking with her son Ricky P Barcita said
suspect arrived and upon passing at the back of her son the suspect pulled his
bolo or sundang and hacked her son in the head (Affidavit hereto attached
as Annexed “D”)
11. In a join affidavit executed by PMSg Rex C Polinag and PSSg
Mark Ian M Guardame disclosed that they received information that there was
a hacking incident at Centro, Purok 2, Brgy. Mapiña, Masbate City, perpetrated
by Ryan Batasingin and was able to apprehend the suspect. (Joint affidavit of
arrest hereto attached as annexed “E”)

IV. INVESTIGATION FINDINGS/ANALYSIS:

17. Perusal of the documents suspect executed the crime without

risk to himself.

V. RECOMMENDATION:

18. Therefore, recommended that a case for Frustrated Murder be

filed against Ryan Batasingin y Soler before the National Prosecution Service,
City Prosecution Office, Masbate City.
