The Unfair Dismissals Act 1977-2007 prevents employees from being dismissed without fair reason. The Act presumes all dismissals are unfair unless the employer can justify them. Fair reasons for dismissal include misconduct, inability to do the job properly, and redundancy if proper procedures are followed. Unfair reasons include not following procedures, dismissing due to trade union membership, inability to prove redundancy, and other discriminatory reasons. Redress for unfair dismissal includes financial compensation up to two years pay, reinstatement with back pay, or reengagement without back pay if the employee contributed to their dismissal.
