SCOPE OF CIVIL SERVICE
COMMISSION
Embraces all branches, subdivisions,
instrumentalities and agencies of the
Government, including government-owned and
controlled corporations with original charters
[Sec. 2(1), Art. IX-B, Constitution]
The Administrative Code of 1987 grants the Civil Service
Commission with the following powers and functions:

Administer and enforce provisions on merit system for all levels and ranks

Appoint and discipline its officials and employees

Control, supervise and coordinate civil service examination

Take appropriate action on all appointments and other personnel matters

Prescribe all forms for civil service exams, appointment, report, forms

Render opinions and rulings on all personnel and other CS matters

Prescribe, amend and enforce rules & regulations for implementing CS Law
CSC’s Jurisdiction on the Appointive Officials

REVIEW APPOINTEE’S QUALIFICATIONS


The only function of the CSC is to review the
appointment in light of the requirements of the
Civil Service Law, and when it finds the
appointee to be qualified and all other legal
requirements have been otherwise satisfied, it
has no choice but to attest to the appointment.
The CSC has the power to:
RECALL OF APPOINTMENT
Includes the authority to recall an appointment which
has been initially approved when it is shown that the
same was issued in disregard of pertinent CSC laws,
rules and regulations.

The CSC has no power to:


a. order the replacement of the appointee simply
because it considersanother employee to be better
qualified.

b. co-manage or be asurrogate administrator of


governmentoffices and agencies.

c. change the nature of the appointment extended


by the appointing officer.
APPOINTMENTS TO THE CIVIL
SERVICE
• All branches, subdivisions, instrumentalities and agencies of
the government, including government-owned and controlled
corporations with original charters are covered by the civil
services and its rules and regulations.

• Appointments to the civil service are based on merit and


fitness determined by competitive examinations, except
appointments to positions which are policy-dtermining,
primarily confidential or highly technical

• The CS Law classifies the positions in the civil service into


career and non-career service positions.
CLASSES OF SERVICE
(1) Career Service – Entrance based on merit and fitness
determined by competitive examinations, or based on
highly technical qualifications, opportunity for
advancement to higher career positions and security of
tenure.

(2) Non-career Service – Entrance on bases other than those


of the usual tests. Tenure limited to a period specified by
law or which is coterminous with the appointing authority
or the duration of a particular project. (i.e. Elective
officials, Department Heads and Members of Cabinet)
Kinds of Appointment
1. Permanent status– an appointment shall be issued to aperson
who meets all the requirements for the position to which he
is being appointed, including the appropriate eligibility
prescribed.

2. Temporary appointment – In the absence of appropriate


eligibles and it becomes necessary in the public interest to fill
a vacancy, a temporary appointment shall be issued to
aperson who meets all the requirements for the position to
which he is being appointed except the appropriate civil
service eligibility.
Qualification Standard of CSC
REQUISITES OF APPOINTMENT
An appoinment, to be valid:

a.requires that the appointment authority be vested with


the power to make the appointment at the time the
appointment is made
b. Appointee possess all the qualifications
c.The position is vacant
d.Appointment has been approved by the CSC
e. The appointee accepts the appointment by taking the
oath and entering the discharge of his office.
OTHER PERSONNEL ACTIONS
I. PROMOTION
-movement from one position to another with increase in
duties and responsibilities as authorized by law and is
usually accompanied by an increase in pay.
II. APPOINTMENT THROUGH CERTIFICATION
III. TRANSFER
-a movement from one position to another which is of
equivalent rank, level or salary without break in service.
This may be imposed as an administrative remedy.
General Rule: If transfer is without consent, it violates security of tenure.

V. DETAIL
– the movement of an employee from one
agency to another without the issuance of an appointment.
(1) Only for a limited period.
(2) Only for employees occupying professional, technical and
scientific positions.
(3) Temporary in nature.
VI. REASSIGNMENT
-An employee may be reassigned from one organizational unit
to another in the same agency.
-It is a management prerogative of the CSC and any dept or
agency embraced in the Civil Service.
-It does not constitute removal without cause.
VII. REEMPOYMENT
-Names of persons who have been appointed
permanently to positions in the career service and who
have been separated as a result of reduction in force
and/or reorganization, shall be entered in a list from
which selection for reemployment shall be made.
Other Concepts in CSC Appointments
• Hold-over Concept – an officer is entitled to hold office until
his succesoor is elected or appointed and has qualified.

• Nepotism as a restriction on appointment


-means favoritism in the appointment of public service in
favor of a relative within the third degree either by
consanguity or affinity (exception:persons employed in a
confidential capacity, teachers,AFP)

• Double Appointment – are not prohited as long as the


positions involved are not incompatible, except that the
officer or employee appointed cannot receive additional or
double compensation unless specifically authorized by law.
