A branch of the Criminal Justice System,


concerned with the custody, supervision
and rehabilitation of Criminal offenders.
Correction came from the root word
"CORRECT" which means to "RIGHT A
WRONG"
Is the study of punishment of crime or
of criminal offender. It includes the
study of control and prevention of crime
through punishment of criminal
offenders.
The term derived from the latin word "
poena " which means " pain or
suffering"
The study and practice of a system
systematic management of jails or
prisons and other institution concerned
with the custody, treatment and
rehabilitation of criminal offenders.
Refers to the manner or practice of
managing or controlling places or
confinement as jails or prisons.
Is a means of social control.
It is a device to cause people to
become cohesive and to induce
conformity.
Defined as the redress that the state
takes against an offending member.
The forms of punishment in primitive
society were:
1. Death penalty
2. Corporal punishment
3. Public humiliation and shaming
4. Banishment.
Death penalty was carried out by:
1. Hanging
2. Burning
3. Immersing in boiling oil
4. Feeding to wild animals
5. Other barbaric ways.
Corporal punishment was inflicted the
offender by:
1. Flogging
2. Mutilation
3. Disfiguration
4. Maiming
Public humiliation and shaming were
effected by:
1. The use of stocks and pillery
2. Docking stool
3. Branding
4. Shaving off the hair, etc.
Retribution - Personal vengeance
Expiation or Atonement - Condemnation of
the whole group against the offending
member. Expiation is therefore, group
vengeance as distinguish from retribution
which is personal vengeance.
Deterrence - punishment gives a lesson to
the offender.

crime if the purpose of imprisonment is
to reform or rehabilitate the prisoner.
Protection as a justification of
punishment came after prisons, were
fully established
People believe that by putting the
offender in prison, society is protected
from his further criminal depredation.
 Punishment makes the criminal cautious about
concealing his criminal activities
 Stigmatizes him and isolates him from society;
makes him a martyr or a hero; and develops in
him an antisocial grudge and a strong
resentment of authority.
 Punishment on the other hand does not deter;
does not repair damage to society; or
reconstruct the personality of the offender.
The principal trends of punishment are in
the development of exemptions, pardon,
and communications; the decline in the
severity of punishment; the growth of
imprisonment and its modifications; good
time allowances; indeterminate sentences;
suspended sentence and probation,
conditional release, parole, short
sentences, and fines.
Upper classmen were often times
exempted from criminal liability for
offences, which caused the commoner
long imprisonment or death penalty.
 Absence of “mens rea” means absence
of a guilty mind or lack of criminal intent.
Right of sanctuary It is the benefit of
clergy was originally given to clerics who
did not wear ecclesiastical robes from
being tried by lay courts but only by
ecclesiastical courts.

offenses, except for homicide or robbery.

CODE OF MARAGTAS- it was allegedly
written compiled by Datu Sumakwel in
1250. Among the provisions the code
robbery , thief where punished by
mutilating off there fingers.
The code was written in 1433 by Datu
Kalantiaw of Panay. The unwritten laws
consisted of customs and tradition. which
was passed down by generation to
generation . Among the provisions are
punishment given to those who caught
having sexual relationship with a married
woman and those who offended religious
object.
The code was made when the Spaniard
colonized the PHILIPPINES by royal
decree of 1870 made the Codigo Penal.
it was made effective in the Philippines
in July 14, 1887.
 Those code was created by the virtue of
Administrative order No. 94 of the DOJ
dated October 18, 1927 to revised Old
penal law.
The act no. 3815 Other known as the
REVISED PENAL CODE. was enacted by the
legislative on December 8, 1930 and took
effect januaryb1 1932 based mainly on
the Spanish codigo penal.
MAMERTIME PRISON- early roman place of
confinement on underground prison
constructed by Roman king Ancus Martius
in Rome called Mamertime prison.
KING HENRY- In 1166 he mandated that
there must be a jail in every country
headed by its sheriff. during said period
and earlier jails where called GAOLS.

to solve the overcrowding of convicted
offenders in jails .Became practice
although it was abruptly in 1778.

greatly barbarity. Lucky he was returned to England
as exchange prisoners having been exposed in
disastrous condition of prison in Europe he wrote a
book entitled " THE STATE OF THE PRISON IN
ENGLAND AND WALES " Which makes him known
as one of the GREATEST PRISON REFORM.
 Howards four basic principle according to his law
on the penitentiary act.
1. Abolition of jailers fee
2. Regular inspection of prisoners
3. Provision of clean facility
4. Emphasis of reforming inmates
 Howards considered as FATHER OF PRISON
REFORM.

sanitary structure, jails inspection
elimination of fees.
18th Century - considered to be one of

criminal. A combination of the old and

Transportation system of convicted
