INDUSTRIAL DISPUTE- UNFAIR DISMISSAL.


Air Asia X alleged that Ms Fazlina had slept on board her flight from Kuala Lumpur to
Perth.

A Show Cause has been issued to Ms Fazlina. The letter requires her to provide her
explanation in writing with regards to the allegations of the misconduct but she
failed to do so.

However, she had already explained the circumstances where she had ‘dozed off
whilst seated in her crew seat during a short break after the in-flight service via her
letter.

The Respondent ignored the Claimant’s explanation and issued a dismissal letter.
The Claimant was dismissed from her service on 10th January 2018 with
immediate effect.
Section 1.14 of the
Safety Emergency Procedures
“under no circumstances, flight attendants are allowed to
read any books, newspapers or other reading materials
during taxi, take-off and landing and must remain alert for
any hazards both inside and outside the aircraft”.
Section 5.1.14 of the Cabin Crew Policy
Manual
“a crew member shall not perform duties on an aeroplane if
he know or suspects that he is suffering from fatigue, or
feels unfit to the extent that the flight may be
endangered”.
Section 5.1.18 of the Cabin Crew Policy
Manual
“a cabin crew shall not commence a flight duty or continue
a flight duty after an immediate landing if he/she is aware
that he/she is too fatigued before the
next landing”.
