THE TAMILNADU REGISTRATION

OF MARRIAGES ACT,2009
By SALINI
Objectives
 to provide for compulsory registration of
all marriages in the State of Tamil Nadu and
for matters connected therewith or incidental
thereto.
 Totally 24 sections are in this Act all about
REGISTRATION OF MARRIAGE
 Marriages solemnized under any personal law
can be registered. (Sec 3)
 Bridegroom/Bride should have completed

21/18 years respectively 


 It can be registered within 90 days without

fine and within 90-150 days with fine. After


that it can't be registered. 
 Proof of marriage is necessary
APPOINTMENT OF AUTHORITIES
Sec 4
State government shall appoint:
a. Registrar General of Marriage for state of Tamil
Nadu.
b. District Registrar for each district to carryout
the purpose of this Act.
c. One or more Registrar of Marriage for one or
more local areas for the purpose of this Act, if
deemed to be necessary.
*District Registrar and Registrar of Marriage are
exercise their power and duties under the general
supervision and control of Registrar General.
MEMORANDUM OF MARRIAGE

SECTION 5
 Parties of marriage shall prepare a memorandum in

prescribed form and deliver it in person to the


marriage registrar within 90 days from the date of
marriage.
 Memorandum shall be delivered or sent to the

registrar within 60 days after the expiry of 30 days


with additional prescribed fees.
SECTION 6 - SIGNATURE AND FEES FOR REGISTRATION
 Every memorandum shall be signed by parties, by the

priest and 2 witnesses and shall be accompanied by


the prescribed fees.
REFUSAL OF REGISTRATION

Sec 7(1)
 Marriage registrar shall satisfied after the scrutiny of document and

memorandum he may refuse to register the marriage


a. Marriage between parties are not performed accordance with personal
law or custom or usage or tradition
b. Testify the Identity of parties, witnesses and their performance of
marriage is doubtful
c. Documents do not prove the marital status of the parties
*After hearing the parties, Marriage Registrar may refuse the registration
and record the reason in writing and enter it in Marriage Register. Before
that he call the parties to produce the correctness of information and
verification of residence by local police station for inquiry.
Sec 7(2)
 Marriage registrar satisfied that no objection to register the marriage, he

may register the same. if not, he may pass the refusal order in writing,
recording with reason.
APPEAL
Sec 8 and 9
Sec 8: Aggrieved party may appeal to The District
Registrar for the order against Marriage
Registrar within 30 days from the date of order
receipt. After given opportunity to the parties he
may confirm the same or direct the Marriage
Registrar to register the marriage.
Sec 9: Aggrieved party may appeal to Registrar
General for the order against District Registrar
with in 30 days from the order date. Registrar
General order shall be final and non appealable.
Marriage certificate
Section 10:
1. On registration marriage registrar shall
issue the certificate of marriage in prescribed
form.
2. Every Registrar shall maintain a marriage
register in prescribed manner.
3. Receipt of memorandum also file in the
same register by registrar.

 Sec 11: Search of marriage register
1. Any person may search the marriage register with fees
payment.
a. Cause a search to be made by registrar for any entry in the
marriage register.
b. To obtain an extract from such register relating to marriage.
2. All extract shall be certified by the registrar and it shall be
admissible in evidence to prove the marriage.
 Sec 12: Register book is open to public inspection with
prescribed fees.
 Sec 13: No Quasi Government Authority shall carryout any
changes in this office record. If the parties want to carryout
changes (Changes in certificate or nomination)that shall be
recorded and copy of certificate issued to parties under Sec10.
Penalty
Sec 14:
* if memorandum may be omits or
neglected to serve by any person
* if false statement is in memorandum
which is known by the parties
* contravenes with this act
Shall be punished with fine, extend to Rupees
1000 or imprisonment for 3 months or both
Penalty
 Sec 15:
◦ Any person secreting destroying or dishonestly or
fraudulently alter the register of marriage.
Shall be punished with fine extend 10,000 rupees or
2 year imprisonment or both.
