Introduction

 Historically, Nepal’s governance structure was


divided into two structure, Centre and District.
 Later, Regional and Zonal structure were added.
 After the abolition of Zonal Commissioner's post,
Zonal administration has been limited.
 Hierarchically, Regional offices are functional.
 Later, during armed struggle in the country,
Regional Administration Office was set-up and it
plays key role in the region.

 Role of Regional administration is to maintain law


and order in the region, monitor and coordinate the
functions of CDOs, liaise with the Government of
Nepal, chair the regional security committee,
monitor the border through CDOs, make necessary
coordination if there is any dispute among districts.
 Regional Police unit is under direct control of
regional administrator in order to maintain law and
order.
District Administration

 In local Administration act, 2028 there is the


provision of district administration.
 Chief District Officer is the Chief Administrative
Officer of the district.
 Other district offices are under district
administration officer for general administrative
purpose, except judicial and defense related offices.
Jurisdiction of district administration

 Basically, jurisdiction of district administration are:


 Maintain law and order in the district,
 Disaster management
 Conduct general administration,
 provide necessary support to the development projects
implemented by DDC, Municipalities, VDCs and
government of Nepal,
 Supervise, preserve and maintenance of government
property in the district,
 Implement the directives given by the government.

 supervise and direct police officers and other police
personnel of the district and keep the secret record
of police officers about their activities,
 Disaster management,
 Prison management,
 Management of weapons and ammunitions,
 Explosive materials management,
 Monitor the activities of foreign nationals,

 Registration and motoring the activities of private
institution and NGOs,

 Organize regular office in charge meeting and try
to solve problems if any,
 Prepare district security profile,
 Carry out functions delegated by Constitutional
bodies or ministries,

 Arrange meeting to solve any problem suffered by


the local citizens,
 Maintain a daily record of incidents in the districts
and report the government through ministry of
home affairs based on their importance,
 Carry out functions which have not been assigned
to any other authority in the district.
Role of CDO in the border district

 Administer control of border by himself or by


administrative officer where border administration
office is there,
 Discuss the mater of the border in the district
security committee,
 Control theft, dacoit, murder, and illegal trade in
the border,
 Protection of vital installations,
 Control communal riot,

 Vigilance of border pillar, monitoring of


international border,
 Border administration and Ilaka administration,
 Inform ministry of home and foreign affairs if
some border pillar found damaged,

 Role of CDO in maintaining Law and Order:


 Order the police to use stick, tear gas, water canon, if
necessary open blank fire to control the mass,
 If mass becomes uncontrolled, order the police to fire
bullet below knee,
 If CDO believes that police can not control the
situation, the he can ask the Nepal Army and Armed
Police Force for the support,
 CDO can prohibit any person to do any thing or to put
any thing at a particular place if it makes situation
tense,

 CDO can impose curfew if situation is worse,


 If curfew is not honored then the CDO can order the
police to open fire,
 CDO can declare any particular area as a violent prone
area, if a mass is out of control and there is a chance of
heavy damage in public property,
 Police can shoot at site,
 District police is under direct control of CDO in
maintaining law and order.
Roles and responsibilities of other offices in the
district

 Other than district administration office, most of


the offices are development related or basic service
providers,
 Development offices' role is to implement
development projects approved by the local bodies
and NPC,
 These offices also provide services through service
centers,

 Local bodies also implement development


programs,
 Besides these, local bodies issue basic certificates
to the people which are primary documents,
 Land revenue office provide services on land
management,
 Govt has also established hospitals, banks,
education offices which also have important role,

 Govt has also established some division offices


which look after more than one district,
 There are offices of local peace committees
established in view of supporting local peace
process, collecting data of conflict victims and
liaise with the government.

 Coordination problem exists among security
agencies,
 Frequent transfer of office in charge,
 They also lack proper training,
 Especially, security agencies face budget
deficiency,
 Political pressure hampers security activities,
 Absence of local elected bodies has hampered
development activities,

 Remote districts face employee shortage problems,


 VDC secretaries look more than one VDC, which
is creating difficulties in providing service in the
district,
 Planning process is top down,
 Most of the citizens have not received citizenship
certificate,
 Records of citizens have been destroyed during
conflict in the country,

 Unnecessary demands of local people have delayed


development projects in the districts,
 Security threat persists in some of the districts,
where employees don’t want to go,
 Unequal distribution of resources and opportunity
have created problems in the districts.

 Mainy, National Planning Commission, Ministry of


Finance, Financial Controller General’s Office,
National Vigilance Centre, concerned ministries are
involved in M &E.
 Other agencies also involve in M&E, such as:

 CDO is supposed to support the development


activities in the district,
 Regional offices also monitor and supervise the
development activities,

 Local peace committees are supposed to monitor


the reconstruction projects,
 Parliamentary committees also have the role to
monitor and supervise the development activities
and direct the government.
 Provision of district level monitoring and
evaluation committee is there in Good Governance
act.
 Governance offices are required to prepare work
performance indicator which will facilitate
monitoring and evaluation.

 Most of the district offices have been established to


provide services to the people,
 Government has initiated to provide services at the
door steps of the people,
 Receiving services is more difficult in remote
districts,
 People have to spend more money in remote
districts as they have to spend more days for the
services,

 In many districts, middle men play key role in


service providing, which increases the cost of
service,
 Some provision of Good Governance act and
activism of media and civil society have helped
improving service delivery,
 But performance evaluation of a government
employee has not been based on the service he has
provided,

 In many districts, records of vital documents have


been destroyed, which is causing difficulty to the
people,
 Inclusive governance is in place, but there should
be done a lot,
 NGOs also provide services, they need to be
supervised closely,
 Monitoring of concerned agencies is poor,
especially in supplying of basic goods,

 It is difficult for the people which don’t have


offices in the district, especially division offices,
revenue offices,
 In many districts offices are not using IT in
providing services,
 System is not working in many cases,
 People feel difficulty while getting services from
police units.

 Unavailability of concerned staffs also hampers


smooth service delivery,
 Monitoring of concerned agencies is poor,
especially in supplying of basic goods,
 What is expected from service centers, it is not
available,
 Absence of local elected body has suffered badly in
providing services,

 Proper implementation of Citizen charter and


compensation mechanism persists,
 Poor infrastructure of some offices is also obstacle
in providing services,
 Most importantly, unfriendly behavior of the
government staff is the major obstacle in the
smooth delivery of public services.
Some issues for exercise
 If you were the CDO in Jhapa, how would you
have dealt with Bhutanese refugee who entered
Nepal from Jhapa?
 You are working in Dailekh district, you got an
information that there is an outbreak of diarrhea
and claimed a dozen lives in Jambukandh VDC. It
is likely that it will spread in other VDCs if not
controlled soon. What will be your strategy?

 You are working in a district where an important
hydro electricity project is under construction. But
the project work is halted because of the
unnecessary compensation demand by the local
people for their land, which govt can’t meet. The
situation is so worst that local people have come to
the headquarters and started vandalizing govt
offices. you realized that police alone can not
handle the situation. What will be your immediate
action?

 You are working in one of the districts where most
of the records of the people have been destroyed
during conflict. But local people are demanding
the copies of their documents time and again. How
will you manage this situation?
 You know that there is a chances of massive
landslide near Dolalghat because of the last year's
earthquake, if it happens it will claim large number
of lives. What will be your plan as a CDO of
Kabhre?

 Some of the wild animals from Koshi Tappu
Reserve, Sunsari, have come out and are now trying
to enter to nearby villages. If they enter, it is almost
sure that lives of local people will be in danger. You
have to take immediate action. What will you do?
 Most of the office in charge in the district are absent
which has caused difficulty in the service delivery
in the district. What will be your primary action to
minimize this problem?

 You know that most of the people in Marchawar
VDC in Rupendehi don’t have citizenship
certificate, they are unable to come to headquarters,
what will you do?
