Who governs Central Consumer protection

authority and how it is regulated?

The Consumer Protection Act of 2019 (the Act) has expanded the range of
consumer rights available to consumers in non-traditional markets such as
e-commerce websites, online sales, direct selling, multi-level marketing, and
so on. To reinforce and defend the interests of customers, new principles
such as "product liability" and "unfair contracts" have been implemented.

• CCPA is regulated by the Central Government.

By Whom is Central Consumer Protection
Authority Formed ?
• The CCPA, which was included in the new Act, seeks to protect consumer
rights by prohibiting unfair trade practises and false or misleading ads that
are harmful to the public's and consumers' interests.
• An Investigation Wing will be established at the CCPA, which will be led by
a Director General. Consumer rights abuses, unfair trade practises, and
false or misleading ads will be investigated by District Collectors as well.
• Nidhi Khare has been assigned the charge of Chief Commissioner,
Joint Secretary in the Department Shri Anupam Mishra as Commissioner,
Director General, BIS Shri Pramod K Tiwari as Director General
(Investigation) and Director General, National Test House, Shri Vineet
Mathur as Additional Director General
How is CCPA Functioned ?
• Consumer Protection Act provides Consumer Rights to prevent
consumers from fraud or specified unfair practices. These rights
ensure that consumers can make better choices in the marketplace
and get help with complaints.
• Section 10(1), in Chapter III of the Act, provides for the establishment
of a ‘Central Consumer Protection Authority to regulate matters
relating to violation of rights of consumers, unfair trade practices
which are prejudicial to the interests of the public and consumers and
to promote and enforce the rights of consumers as a class.
Who HAS most saying in Central Consumer
Protection Authority(Which government Central or
state)
• The Central Government has the most saying the central consumer protection authority.
• The Central Authority enjoys sweeping and wide-ranging powers under the Act and can
discharge functions which are regulatory, investigative or adjudicatory in nature. These
include the power to:
(i) inquire or cause an inquiry into violations of consumer rights or unfair trade
practices, either suo moto or on a complaint or on directions from the Central
Government [Section 18(2)].
(ii) cause investigation to be made by the Director General or by the District Collector
if it is satisfied, after a preliminary inquiry, that there exists a prima facie case of
violation of consumer rights or any unfair trade practice or any false or misleading
advertisement prejudicial to public interest or to the interests of the consumers
[Section 19(1)].
