• One of the most significant additions to the 2019 Act is to establish CCPA.
• It Set up under Section 10(1) of the Consumer Protection Act, 2019
• To regulate matters, inter alia, relating to false or misleading
advertisements which are prejudicial to the interests of public and
CENTRAL consumers as a class.
CONSUMER • The objective of the Central Consumer Protection Authority (CCPA) is to
promote, protect and enforce the rights of consumers as a class.
PROTECTION • It will be empowered to conduct investigations into violation of
AUTHORITY consumer rights and institute complaints / prosecution, order recall of
unsafe goods and services, order discontinuation of unfair trade practices
(CCPA) and misleading advertisements, impose penalties on
manufacturers/endorsers/publishers of misleading advertisements.
• The Central Authority shall consist of a Chief Commissioner and other
Commissioners as may be prescribed, to be appointed by the Central
Government.
• The Central Authority shall have an Investigation Wing headed by
a Director General For the purpose of conducting inquiry or investigation
under this Act.
• The CCPA has to regulate, protect and enforce the interest of the
consumers and matters related to unfair trade practices.
• The CCPA has been provided with vast powers to inquire,
investigate and take action against violations of the 2019 Act.
CENTRAL • Another significant power the CCPA has been showered with,
is the power to take action and impose penalty against
misleading and false advertisement as well as against any
CONSUME endorser of such advertisement.
