• A Bulk vessel on Time Charter en-route from port


of Chennai in India to port of Yokohama in Japan
has been deviated to port of Keelung in Taiwan
to collect urgently needed spare parts for repair
and dry docking for 04 days. The ship proceeded
at 13 knots on a consumption of bunker as per
Voyage charter party, Fuel Oil (FO) and Diesel Oil
(DO) at 20 MT and 01 MT per day at sea and
respectively and DO 02Mt/ per day in the port.

1. Under a Demise or Bareboat Charter party the Charterer is


responsible for providing the cargo and crew, whilst the Ship Owner
only provides the vessel. As a result the charterer takes full
responsibility for the operation of the Vessel, and pays all the expenses
incurred.
 

2. If a ship loads and/or discharges in less than the


prescribed time, the Owners pay a despatch money as a
reward for the time saved.
 

3. If, on the other hand, the prescribed time is exceeded,


then Demurrage must be paid at an agreed rate to the
Ship owner as compensation for the delay of the ship.
 
4. Charterer’s liability ceases after the cargo has been loaded
and when the freight, dead freight or demurrage has been
paid.
 
5. In the Voyage Charter the ship owner agrees to carry cargo
between specified ports at a prearranged freight.
 
6. The majority of tramp cargo shipments are made on a
voyage charter basis.

7. The Salvage Clause permits the vessel to put Into a port of


refuge in order to save life and property and also for the
purpose of deviation.
Force Majeure

• Charterer and Owners exempt each other


from responsibility for non- performance of
the Charter party agreement when it is
caused by ‘Act of God’, Governmental,
Institutional Restrictions or any other cause
beyond control of either party.
