There are tendency to mythologize the scope of a guidance Councelor ‘s ethical privacy
obligations , For example , a guidance Councelor providing SAP Counceling may be
reticent to share information regarding the nature of Counceling and the incidents giving
rise to the Counceling with members of an IEP team , such as reticense illustrates a mis
understanding of the scope and definition of Confedentiality.
In the same fashion , the guidance Councelor is one member of an organization with clear
privacy obligations . Even those guidance Councelors who by virtue of collateral licenses
have a statutory confidentiality obligation, are not constrained from disclosing relevant
information to the IEP Team . This is particularly true where the IEP team is under a

Minor students should be informed of the Councelors general obligation to disclose information

Legal counsel should be sought when a guidance Councelor
encounters a “ grey area”

paramount in the Councelors consideration.

The Professional school Councelor:
a). Inform Parents of the Councelors role with emphasis on the confedential nature of the Councelling relationship
between the Councelor and counselee.
b). Provides parents with accurate , comprehensive and relevant information in an objective and caring manner as
appropriate and consistent with ethical responsibilities to the counselee.
There are practical ways in which a guidance Councelor can reduce the frequency with
which they will be challenge by the question of disclosure to parents .
First and foremost , they can adhere to the ethical guidelines which favor parental
involvement in most circumstances.
Second they can develop a habit of letting the students know “ up front ‘ what their
expectation should be with regard to disclosure /nondisclosure .
Third, they can limit their scope of responsibility to area which fail with in the domain of
guidance Counceling .
When the guidance Councelor is confronted , with the issue of whether or not the
disclosure information to the parents ,involving a child above the age of 15 , the
determine will probably be very fact specific . Under such circumstances, it is advisable
to seek the advice of the school legal counsel.
Ultimately , the Councelor should bear in mind that the guidance Councelor have been
used for failing the disclosure information to parent. This is great part due to the fact that
any civil suit by a minor must be brought in the name of parents .

circumstances where a parent presents a treat of physical harm or sexual abuse to child ,
