What is DIVORCE?

• A divorce is a legal action between


married people to terminate their
marriage relationship. It can be
referred to as dissolution of marriage
and is basically, the legal action that
ends the marriage before the death
of either spouse.

How does it work?

• In most countries, divorce requires the sanction of a


judge or other authority in a legal process to complete a
divorce. A divorce does not declare a marriage null and
void, as in an annulment, but divorce cancels the
marital status of the parties, allowing them to marry
another.

ANNULMENT VS DIVORCE

• Divorces and annulments both have the same effect--


they dissolve the marriage. However, they differ in how
they treat the marriage. When people get a divorce,
they're still recognized as having been married
previously. An annulment, on the other hand, treats the
marriage as though it never existed -- and in fact, the
key distinction of an annulment is that the union wasn't
legal or legitimate to begin with.

DIVORCE in the Philippines

• The Philippines' lower house of Congress has passed


a divorce bill on the third reading, moving the country
closer to legalization. The bill passed despite opposition
from President Rodrigo Duterte, who had his own
marriage legally annulled.

• In the Philippines, the only country in the world


besides the Vatican City where divorce is prohibited,
there are only two options for separation. One is legal
separation, and the other is a declaration of nullity or a
legal annulment.

PROHIBITION of DIVORCE

• In the Philippines, a married couple cannot divorce by


law. Regardless of where they live, this law follows
them throughout the entire world. Article 15 of the
New Civil Code states that laws pertaining to familial
rights and responsibilities, or to the standing, form
and legal capability of persons, are compulsory upon
inhabitants of the Philippines even though residing
overseas. Therefore, Filipinos are still under the rule
of their land even if they are in another location.
