Who Is Consumer???
• Buys any product.
• Uses a product with the approval of its buyer.
• Hires any service.
Such a person as above is called a ‘consumer’. It must be noted
that the size of the product or the amount of money paid for the
purchase is irrelevant. So, a consumer case can be filed in
connection with purchase of a pen as well as for purchase of a
penthouse and also includes offline or online transaction through
electronic means or by Tele shopping/Direct-selling/multi-level
marketing.
Who is NOT a Consumer?
The person who
 Obtain Goods or Services for Free.
 Obtain Goods or Services for the purpose of
Resale (Means of Commercial purpose).
But person of Goods bought and used by him
exclusively for the purpose of earning his livelihood
by means of self-employment is a CONSUMER.
Consumer Rights
Six consumer Rights have been defined in the Bill
1. Be Protected against Marketing of Goods and Services
which are hazardous to life and property.

2. Be informed of the Quality, Quantity, potency, purity,


standard and price of Goods or Service.

3. Be assured of accesses to variety of Goods or Services


at a competitive price.

4. The Right to be heard and to be assured that consumer


interest will receive due consideration at appropriate for a.

5. The Right to seek Redressal against unfair trade practices or


restrictive trade practice or unscrupulous exploitation of consumer
and
6. The Right to Consumer Awareness
Complaints to Authorities
A complaint relating to violation of consumer rights or unfair
trade practices or false or misleading advertisements which are
prejudicial to the interests of Consumer as a class, may be
forwarded either in writing or in electronic mode, to any one of
the Authorities namely :-

 The District Collector or


 The Commissioner of Regional Office
or
 The Central Authority
Central Consumer Protection Authority
• The central government will set up a Central Consumer
Protection Authority(CCPA) to promote, protect, and
enforce the rights of consumers. It will regulate matters
related to violation of consumer rights, unfair trade
practices, and misleading advertisements.
• The CCPA will have an investigation wing, headed by a
Director-General, which may conduct inquiry or
investigation into such violations.
 “Defect" means any fault, imperfection or
shortcoming in the quality, quantity, potency, purity or
standard which is required to be maintained by or
under any law for the time being in force under any
contract, express or implied or as is claimed by the
trader in any manner whatsoever in relation to any
goods;
 “Deficiency in Service“ means service of any
description which is made avail­able facilities in
connection with Banking, Financing, Insurance,
Transport, Processing supply of electrical or other
energy, Telecom, Board or lodging or both, Housing
Construction, Entertainment, amusement or the
purveying of news or other information but does not
include rendering services free of charge.
WHO CAN FILE THE COMPLAINT?
Complainant means :-
 A Consumer
 Any Voluntary consumer association registered
under any law
 The central Govt. or any State Govt.
 The Central Authority
 One or more consumers where there are
numerous consumers having the same interest
 In case of the death of a consumer legal hires
 In case of the consumer being a minor his
parent or legal guardian

Mediation

 For the purpose of Mediation the National Commission,


State Commission or the District Commission shall prepare
a panel of the mediators to be maintained by the consumer
mediation cell attacked to it on the recommendation of a
selection Committee of that commission.
 Where the consumer Disputes could not be settled by the
mediation the District Commission, the State Commission ,
the National Commission shall continue to hear all the issue
involved in such consumer Disputes.
OFFENCE AND PENALTIES
Penalty for non-compliance of direction of Central Authority –

Whoever, fails to comply with any


direction of the Central Authority
under Sections 20 and 21, shall be
punished with imprisonment for a
team which may extend to six months
or with fine which may extend to
twenty lakh rupees, or with both.
PUNISHMENT FOR FALSE OR MISLEADING
ADVERTISEMENT

Any manufacturer or service provider who


cause a false or misleading advertisement
to be made which is prejudicial to the
interest of consumers shall be punished
with imprisonment for a term which may
be extend to two years and with fine which
may extend to ten lakh rupees; and for
every subsequent offence, be punished
with imprisonment for a term which may
extend to five years and fine which may
extend to fifty lakh rupees.
