The electoral process is a mechanism which the


very purpose is the expression of the political will of
the people. The right to express partisan ideas must,
therefore, be firmly guarded during electoral periods.
2. FREEDOM OF PEACEFUL ASSEMBLY

Public demonstrations and political rallies are an


integral part of the electoral process and provide
an effective mechanism for the public
dissemination of political information.
3. FREEDOM OF ASSOCIATION

Respect for this right is vital during electoral


process as the ability to form and join political
parties is one of the most important means in a
democratic process.
4. FREEDOM OF MOVEMENT

It is essential that all those participating in the


electoral process are able to move without
restriction, fear, and have access to all electoral
events and related venues.
5. FREEDOM FROM DISCRIMINATION

The right to political participation must be enjoyed


equally by all and without distinction or
discrimination of any kind.
6. FREEDOM FROM FEAR AND INTIMIDATION

Participation in the electoral process must be


conducted in an atmosphere characterized by an
absence of intimidation and by respect for human
rights and fundamental freedom.
PROACTIVE MEASURES AGAINST INTERFERENCE OF
GUARANTEED RIGHTS DURING ELECTORAL PROCESS
1. Continuous conduct of orientation and education on human rights
to PNP personnel to be deployed during the 2023 Synchronized
BSKE;
2. Coordination with other agencies in the promotion of human rights;
3. Production and distribution of IEC materials on human rights;
4. Deployment of Human Rights Officers in the places of engagement
of political assembly/party; and
5. Strict observance of Human Rights-Based Policing and POP
during the conduct of 2023 Synchronized BSKE.
REACTIVE MEASURES AGAINST INTERFERENCE OF
GUARANTEED RIGHTS DURING ELECTORAL PROCESS
1. In cases where an arrest was made, observance of
humane treatment shall be accorded as guaranteed in
10 Basic HR Standards for Law Enforcement Officials;

2. Human Rights Officers shall monitor in the


investigation process. No torture, force, violence,
threat, intimidation, or any other means which vitiate
the free will shall be used against him;
3. In cases where PNP personnel violated any rights
guaranteed, appropriate criminal and/or administrative
charges shall be instituted;
4. Continuous close coordination with COMELEC and
other agencies; and
5. Art. III Sec. 18, 1987 Philippine Constitution:
(1) No person shall be detained solely by reason of
his political beliefs and aspirations.

• RA 7438 - Rights of Person Arrested, Detained or Under
Custodial Investigation as well as the Duties of the
Arresting, Detaining and Investigating Officers
• RA 9745 - An Act Penalizing Torture and Other Cruel,
Inhuman and Degrading Treatment or Punishment
• RA 9851 - An Act Defining and Penalizing Crimes Against
International Humanitarian Law, Genocide and Other Crimes
Against Humanity, Organizing Jurisdiction, Designating
Special Courts
