MEDIATION AND

CONCILIATION COMMITTEE
1. LEGAL BASIS
A measure instituting a Mediation Code
providing mediation and conciliation mechanisms
with emphasis con compassionate conflict
management among stakeholders of cooperative
values and cooperative principles as mandated by
the Cooperative Code.

2. POLICY
The Mediation/Conciliation process shall be
conducted in accordance with the following
principles:
a. To actively promote party autonomy in the resolution of disputes in
accordance with the principles of compassionate conflict
management.
b. All disputes shall be resolved amicably at the Coop level under the
principle of subsidiarity.
c. The Mediator shall be guided by the Cooperative Principles in the
conduct of mediation/conciliation process towards the disputants.
d. It is a speedy and inexpensive process where no technical rules of
evidence shall be applicable.
e. The submission of the disputes or by disputants to the jurisdiction of
the Mediator or Conciliator shall be completely voluntary free from
any form of duress.
f. The entire mediation/conciliation process shall be strictly confidential.
However, transcript of the proceedings shall be taken during the
process to guide the Mediator in reaching settlement options and that
all notes and admissions of the disputants shall be inadmissible in any
other proceedings.
g. The independence and autonomy of the
Mediation/Conciliation Committee, the Mediator or
Conciliator shall be inviolable.
h. The Mediator or Conciliator shall be neutral free from any
semblance of impartiality in the conduct of its affairs and
shall be insulated from all types of external pressures and
influences.
i. This Code shall be liberally construed in favor of attaining
the paramount objective of amicably resolving disputes of
the disputants at the Coop Level.
3. DUTIES & FUNCTIONS
a. Formulates and develop Mediation-Conciliation Program and ensure that it is
properly implemented;
b. Formulates A Mediation/Conciliation Guidelines for the conduct of mediation
and conciliation of disputes;
c. Monitors Mediation/Conciliation program and processes;
d. Accepts and File Evaluation Reports;
e. Submits recommendations to the Board of Directors on matters about
mediation and conciliation of disputes;
f. Recommends to the Board of Directors any member of the cooperative
aspiring to become a Mediator-Conciliator who is willing and qualified to
undergo Mediation and Conciliation Training;
g. Performs such other functions as maybe prescribed by the By-laws or as
directed by the Board of Directors or authorized by the General Assembly on
matters pertaining to cooperative disputes.
4. NATURE OF APPOINTMENTS
The Mediation/Conciliation Coordinator must
be a member of the management staff of
MACDECO. The Board of Directors, through the
General Manager shall designate who will be its
own Mediation/Conciliation Coordinator.
5. COMPOSITION MEMBERSHIP
Section 1. Composition

A Mediation and Conciliation Committee is hereby
created and shall be composed of three (3) members to
be appointed by the Board of Directors. The Committee
shall elect from among themselves, the Chairman, Vice
Chairman and Secretary.
Section 2. Qualifications

1. Bachelor’s Degree
2. At least 30 years of age;
3. Must have attended the required trainings/seminars for mediation and
conciliation committee, preferably on the Basic Cooperative Course,
Leadership Seminar and Conflict Management;
4. Not being charge or convicted of any administrative or criminal cases;
5. Member in good standing (MIGS);
6. Must possess a “tolerable emotional quotient” (TEQ) under
circumstances, with ability to work in tense conflict situation.
Section 3. Vacancy
Any permanent vacancy in the Committee shall be
filled by the Board of Directors within two (2) months
from the date the vacancy arise. However, the newly
appointed member shall perform the duties and function
for the remaining unserved portion of the term only.

6. ENGAGEMENT AND ACTIVITIES IN MACDECO


Bring delinquent members back to active status.
7. CHANGES, ISSUES & CONCERNS
 Difficulties in collecting remaining balance to a
delinquent member
 Person to do collecting task
 Commission & Incentives given to collecting person
 To add funds to the existing value/amount money of
the cooperative.
