ENVIRONMENTAL LEGAL NORMS FOR

REGULATING THE INTERACTION BETWEEN MAN
AND NATURE
Environmental protection consists of the following two rules:
• legal protection in the form of enforceable laws formulating scientific

ecological principles;
• financial incentives to industries for trying to make environmental
protection activities economically viable.
The concept of environmental law is

A general section on institutions and regulations relevant to environmental law; subject,

methods of environmental law, environmental legal relations, ownership rights to natural
resources, the right to use and regulate nature, environmental expertise, legal responsibility
for environmental law violations.
The main section consists of sections such as legal regulation of the protection and use of
land, atmospheric air, subsoil, forests, animal world, specially protected areas.
Special section on issues of international environmental protection rights.

The peculiarity of the legal regulation of
environmental relations is the priority of
influencing by administrative-legal method.
That is, the legal inequality of both sides (characteristic of the civil law method), the
relationship of authority and subordination. In this case, the nature protection bodies,
which must carry out this activity in accordance with the requirements of the law and
represent the interests of the society and citizens, have power.
Recently, in the field of legal regulation of environmental relations, the role of

influence through economic or financial mechanisms has begun to increase.

THE CONSTITUTION
The Constitution of the Republic of Kazakhstan is the main source of
environmental law. According to the Constitution of the Republic of
Kazakhstan, "every person has the right to receive clear information
about the health of a person or the world's property, the state of the
environment and the compensation of damages caused by violations
of environmental law."
In the Republic of Kazakhstan, land and other natural resources are

the basis of life of people living in that territory. If there is no harm to
the environment and the rights and legal interests of other people are
not violated, then the use of land or other natural resources is carried
out freely by their owners.

The Law of the Republic of Kazakhstan "Protection of the

Natural Environment" defines the tasks of nature
protection laws - regulation of the relationship between
society and nature while preserving natural resources and
the natural habitat of man, prevention of harmful
environmental effects during human economic life,
improvement of the quality of the environment, the
interests of current and future generations. to maintain law
and order and strengthen legality.

OUR DUTY AND RIGHT

Every citizen has the right to protect his health from adverse
effects of the environment - anthropogenic effects, accidents,
earthquakes, natural disasters. The mechanism of providing
this right includes design and regulation of environmental
quality, prevention of harmful environmental effects, warning
of accidents, catastrophes, natural disasters and elimination of
their consequences.

and natural resources:

and Subsoil Protection of the Ministry of Energy and Mineral Resources;

improvement of rivers, lakes, reservoirs and other surface water sources - Committee on
Water Resources of the Ministry of Environment and Natural Resources Protection;

on monitoring the release of harmful substances from cars into the atmosphere, organization
of environmental police work - Ministry of Internal Affairs;

on supervision of compliance with sanitary and hygienic standards of the surrounding
natural environment - carried out by the Health Care Agency.
