MANIFESTATION/EXPLANATION
UNDERSIGNED COUNSEL for the Accused, in compliance with the COURT
ORDER dated 12 September 2007 and received on 19 September 2007, most respectfully
avers: THAT
1. It is true that both parties have agreed to have the case ADJUSTED for hearing
of defense evidence on September 12, 2007 instead of September 7, 2007 as scheduled by
the Court because both counsels had previous commitments on said date; Undersigned
counsel had his SC-PHILJA training for Family Court Mediators in Cebu City on Sept. 57, 2007.
2. However, private prosecutor Camilo Camenforte called up the undersigned
defense counsel on September 11, 2007 that he could not make it on September 12, as he
has just been operated for cataract, and requested that the parties reset the same on a
common date, which is November 7, 2007.
3. Understanding the plight of private prosecutor, and not taking advantage of his
absence in court and the mutual respect for a fellow lawyer, the undersigned counsel
undertook to call the clerk of court of this Honorable Court as well as his client (the
accused) to make the necessary adjustment of the hearing of this case. That is the reason
why there was no motion coming from either counsel due to the short notice (September
11, 2007) and the great distance from Tacloban to Guiuan.
4. Foregoing premises considered, the undersigned counsel begs the kind
indulgence of this Honorable Court for the non-appearances of both counsels on 12
September 2007, which is not in any way intended to delay the proceedings of this case.
