MOTION TO CANCEL HEARINGS

UNDERSIGNED COUNSEL for the ACCUSED, unto this Honorable Court
most respectfully avers: THAT--1. Per notification, this case is scheduled for continuous hearings on
January 21 & 28 and February 11 & 25, 2008 at 8:30 oclock in the morning.
2. Unfortunately, the scheduled hearing on 21 January 2008 was
cancelled because the Honorable Judge presiding over this case was sick and
indisposed;
3. However, on the next scheduled hearing on 28 January 2008, the first
witness for the defense, Hon. Municipal Councilor Clodualda Lacaba (former
SAMELCO 2 Director) is not available, considering that she will attend the 9 th
National Summit of Lady Local Legislators Phil. League on January 24-26, 2008
and will be staying in Manila until January 28. Moreover, undersigned counsel
has a pre-scheduled preliminary conference of Rodolfo Pfleider II vs. Eagle Star
Transit Corp. at RTC Br. 9,, Civil Case No. 2006-10-118.
4. Likewise, on 11 February 2008 at 2pm, counsel will appear in an
election protest of Leoncio Albaos vs. Maria Luz Maquincio before the Municipal
Trial Court of Dagami, Leyte in Election Case No. 383.

5. This motion is not designed to delay the proceedings of this case but is
based on valid and reasonable grounds.
6. Undersigned Counsel will make himself available for the next scheduled
hearing of this case on February 25, 2008 at 2:00 oclock in the afternoon.
WHEREFORE, premises considered, it is respectfully prayed of this
Honorable Court to cancel the hearings of this case on January 28 and February
11, 2008.
