EX-PARTE MOTION FOR POSTPONEMENT

COMES NOW Plaintiff, through counsel, unto this Honorable
Court, most respectfully avers:
1. That the above-entitled case is set for hearing on January
8, 2013 at 8:30 in the morning for the purpose of
partitioning the disputed property, hence, requiring the
presence of both parties;
2. That however, the plaintiff has yet to arrive in the country
on the last week of the present month, that is, between
January 27 and 30, 2013;
3. That confronted with the above-mentioned circumstance,
the plaintiff cannot attend the hearing of the instant case
on its scheduled date;
PRAYER

WHEREFORE, premises considered, it is most respectfully

prayed that the hearing set on January 8, 2013 at 8:30 in the
morning be set to another date preferably on February 12, 2013
in the morning or at the convenience of this Honorable Court.
Other reliefs deemed just and equitable in the premises are
similarly prayed for.
