If a pesticide contacts a person or causes damage to non-target plants or areas, there may be a violation of federal and/or state law. The Michigan Department of Agriculture and Rural Development (MDARD), Pesticide and Plant Pest Management Division is the agency responsible for regulating pesticides in Michigan. FILING COMPLAINTS You should file a complaint with the MDARD if you have been exposed to pesticides. You should also file a complaint if you feel you are not receiving proper protection from pesticide exposure while working in agricultural plant production on farms, forests, nurseries, or greenhouses. The WPS makes it illegal for employers to retaliate against employees filing complaints. Provide as much information as you can about the exposure incident. For example: name of person(s) exposed, date and time of incident, location of the incident (address, road, farm owner etc.), what crop or site was or was being sprayed, what spray equipment was being used, were exposed persons aware that an application was taking place? Are there any witnesses MDARD can contact? If yes, how can they be contacted, was medical attention involved, if yes, where? Describe injury symptoms or illness, Can MDARD contact the complainant?
