Dear Mr Letts Thank you for your letter about the Penalty Charge Notice (PCN) you received regarding BH60554071. The Civil Enforcement Officer (CEO) issued the Penalty Charge Notice under the Traffic Management Act 2004 to T133JTD on 24/07/2012 at 10:20:35 in Port Hall Avenue (Q). The CEO issued it as your vehicle was seen parked in a residents or shared use parking place or zone without clearly displaying either a permit or voucher or pay and display ticket issued for that place. The CEO took the following photographs which show that no ticket was on display when the PCN was issued.

I have read your informal representation (appeal) and understand that you purchased a pay & display ticket. I have considered the information given and, after careful consideration of the details, decided to reject your informal representation for the following reasons. When using Pay & Display parking spaces it is the motorist's responsibility to ensure the ticket is clearly displayed, showing the expiry date and time, before leaving the vehicle unattended. I note the provision of a valid ticket but this was not visible to the CEO at the time. The CEO noted that all windows were checked and no ticket was seen, and this is supported by the photographs taken at the time. As your informal representation has been rejected you now have two options: Option 1 Pay at the discounted rate Please make a payment of 35.00. This is the discounted rate that applies for 14 days. After the 14 days this will increase to 70. Please see details of how to pay below: Online using Visa/Delta/MasterCard/Switch at www.brighton-hove.gov.uk/parking and follow the Penalty Charge Notices link. By phone using Visa/Delta/MasterCard/Switch. Please call 0845 603 5469 and select Option 1. This is an automated service so you can call at anytime. By cheque or postal order made payable to Brighton & Hove City Council. This should be sent to PO Box 4680, Worthing, BN11 9GR. Please include the PCN number with your payment so that we can find the right case. In person at our Parking Information Centre at Hove Town Hall, Norton Road, Hove.BN3 3BQ. Please see our website for opening times. Option 2 Appeal further and make a formal representation If you do not make a payment of 35.00 within 14 days the charge will increase to 70. If the PCN remains unpaid we will send a Notice to Owner to the Registered Keeper of the vehicle.

The Notice to Owner means that the Registered Keeper can either: make full payment of 70 appeal against the issuing of the Penalty Charge Notice. They do this by making a Formal Representation in writing to the council. The Notice To Owner will contain the full details on how to do this. Please be aware that you must wait for a Notice to Owner to be issued to the Registered Keeper in order to activate the next stage in the appeals process.
