APPLYING ON FORM ECAA 3 : GUIDANCE NOTES

This form is to be used only to apply for an extension of stay in the UK as the dependant of a Turkish national who already has leave to enter or remain in the UK as a businessperson or a worker under the ECAA with Turkey. However, if your Turkish national family member is now applying for an extension of stay or indefinite leave to remain (indefinite leave to remain applies to businesspersons only), he or she should include you and any other eligible dependants in his or her own application on form ECAA 1 or ECAA 2. Form ECAA 3 is only to be used if, for whatever reason, dependants are having to apply separately for an extension of stay in line with the family member who has already been granted leave as a businessperson or a worker. Form FLR(O) should be used by dependants applying separately for indefinite leave to remain on that basis. You and any dependants included in the application must be in the UK to apply. 2 QUALIFYING FOR AN EXTENSION OF STAY

Use a black pen to complete the form - and capital letters for names, addresses and similar details. Section 1 This is where you give your own details. Leave a space between each name or part of the address(es) required in this section (do the same where names and addresses are required in other sections). Sections 1 and 2 You must provide the photographs of yourself and any dependants included in the application. Use one staple or paper clip in each person’s case to attach them to the spaces provided. Do not use glue or any other sticky adhesive. See part 7 of these notes for more guidance on photographs. To qualify for an extension of stay, the person of whom you are a dependant must have existing leave to enter or remain under the Turkish ECAA, and you must prove that you and any other dependants included in the application are related to him or her as claimed.In addition, if you are the dependant of a businessperson, you will need to show that the profits of the business are sufficient to support you. The published policy on businesspersons is in Chapter 6 Section 6 of the Immigration Directorate Instructions and on ‘Turkish Workers’ in Chapter 5 Section 10 which are on the ‘Law and Policy’ pages on our website at www.bia.homeoffice.gov.uk Only the partner and/or children under 18 of the businessperson/worker. 3 WHO CAN APPLY ON THIS FORM?

Section 6 This section lists the documents and photographs which you have to provide. If you can’t provide any of the documents specified in the application form, please explain why in a letter with the form and say when you will be able to provide them. See part 8 below for more guidance on documents. Section 7 Sign and date the declaration. If you don’t, the application will be incomplete. 7 PHOTOGRAPHS

You must provide the following photographs:

Two identical passport-size photographs of yourself with your name written on the back of each photograph.

Unless otherwise stated, the word “partner” in these guidance notes means a spouse, civil partner, unmarried or same sex partner. You should apply before the end of your authorised stay in the UK. Your application will be delayed if it is incomplete. The photographs should be in colour, recent (within the last month), and approximately 45 millimetres high and 35 millimetres wide, the size of a passport photo.

Each photograph must show the individual’s full face clearly against a light background. Sunglasses are not acceptable. Nor is any head covering unless this has to be worn for religious or cultural reasons. But if the covering conceals the face, this will not be acceptable. If the application(s) is/are successful, the photographs provided will be reproduced in your passport and those of any other dependants included in the application. 8 DOCUMENTS Documents provided with the application must be originals.

Exceptionally, a certified copy may be acceptable. The copy must be certified by the body or authority which issued the original (for example, a copy of a savings book certified by the building society or bank), or by a notary. The reasons for providing a certified copy rather than the original document must be explained in a covering letter.

The Rehabilitation of Offenders Act 1974 enables criminal convictions to become 'spent' or ignored after a 'rehabilitation period'. The length of the rehabilitation period depends on the sentence given. For a custodial (prison) sentence the rehabilitation period is decided by the original sentence, not the time served. REHABILITATION OF OFFENDERS ACT 1974

This guidance is not exhaustive. The full definitions of war crimes, crimes against humanity and genocide can be found in Schedule 8 of the International Criminal Court Act 2001 at www.opsi.gov.uk/acts/acts2001/20010017.htm or purchased from The Stationery Office (telephone 0870 600 5522). It is your responsibility to satisfy yourself that you are familiar with the definitions and can answer the questions accurately on behalf of yourself and any dependants included in the application. War crimes Grave breaches of the Geneva Conventions committed during an armed conflict. This includes an internal armed conflict and an international armed conflict. The types of acts that may constitute a war crime include wilful killing, torture, extensive destruction of property not justified by military necessity, unlawful deportation, the intentional targeting of civilians and the taking of hostages. Crimes against humanity Acts committed at any time (not just during armed conflict) as part of a widespread or systematic attack, directed against any civilian population with knowledge of the attack. This would include offences such as murder, torture, rape, severe deprivation of liberty in violation of fundamental rules of international law and enforced disappearance of persons. Genocide Acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group.

For the purposes of answering questions 5.3 to 5.7, the following information provides guidance on actions which may constitute war crimes, crimes against humanity, genocide, or terrorist activities.
