WHEREAS, Independent School District No. 255, Pine Island, Minnesota
(the School District) is a school district duly formed and organized pursuant to Minnesota law; and
WHEREAS, Elk Farm Four, LLC (Elk
Farm) is a limited liability company
formed pursuant to Delaware law, and
WHEREAS, Elk Farm presently owns
a parcel of real property in Olmsted
County, Minnesota, which is more particularly described in the attached Exhibit A (hereinafter the property); and
WHEREAS, Elk Farm desires to sell,
transfer and convey, for the nominal
consideration of $1.00 and other good
and valuable consideration, all of Elk
Farms right, title and interest in and to
the Property to the School District.
NOW, THEREFORE, BE IT RESOLVED
by the School Board of Independent
School District No. 255 as follows:
1. The Chair and Clerk of the School
Board are hereby authorized to execute
and deliver a certain Purchase Agreement for the Property, as well as all
other instruments and agreements necessary to complete the conveyance of
the Property to the School District.

take all necessary and appropriate action to complete the conveyance contemplated herein.

REIMBURSEMENT RESOLUTION:
Because of our construction timeline,
we would like to go ahead with this
resolution. Member Douglas moved the
adoption of the following resolution:
RESOLUTION ESTABLISHING PROCEDURES FOR REIMBURSEMENT OF CERTAIN EXPENDITURES FROM PROCEEDS
OF FUTURE BOND ISSUES OR OTHER
BORROWINGS
BE IT RESOLVED by the School Board
of Independent School District No. 255,
State of Minnesota, as follows:
1. Purpose. The Internal Revenue
Service has issued Treasury Regulations
Section 1.150-2 (the Regulations) to
provide rules governing Bonds issued
after June 30, 1993, the proceeds of
which are allocated to reimburse an
Issuer for certain expenditures made
prior to the date of issue of those Bonds.
An allocation of the proceeds of a Bond
issue to reimburse certain previously
paid expenditures must comply with the
Regulations to be an expenditure of Bond
proceeds. If a Bond meets the requirements of the Regulations, the Bond proceeds are deemed to be spent when
they are allocated to reimburse the prior
expenditure. The Board of Independent
School District No. 255 (the District)
desires to establish procedures necessary to comply with those Regulations.
The terms used in this resolution shall
be as defined in the Regulations.
2. Official Intent Requirement. The
Regulations, in those situations in which
they are applicable, require a District to
declare a reasonable official intent (the
Official Intent Declaration) to reimburse itself for certain previously paid
expenditures from the proceeds of subsequent Bonds or other borrowings of
the District (the Bonds). The Board
hereby authorizes the superintendent
or the business manager to make the
Districts Official Intent Declarations or
to delegate that responsibility from time
to time to other appropriate District officers or employees. Each Official Intent Declaration shall comply with the
requirements of the Regulations, including, without limitation, the following:
a) Each Official Intent Declaration shall
be made not later than sixty (60) days
after the date the District pays the applicable expenditure and shall state that
the District reasonably intends to reimburse itself for those expenditures with
the proceeds of a future borrowing:
b) Each Official Intent Declaration shall,
at a minimum, contain a general functional description of the property, project,

or program for which the expenditure to


be reimbursed is paid (for example, acquisition and betterment of school facilities or a specific identifiable project).
In the alternative, a description is sufficient if it identifies the fund or account
from which the expenditure is to be paid
and a general functional description of
that fund or account (for example: General Fund - general school district operations and maintenance; Capital Expenditure Fund - chool district equipment
and capital improvements);
c) Each Official Intent Declaration shall
contain a statement of the maximum
principal amount of debt to be issued
for the purposes of the specified property, project, or program;
d) Each Official Intent Declaration shall
be considered public data and shall be
made available for public inspection in
compliance with the Minnesota Government Data Practices Act at the main
administrative offices of the District within
a reasonable period of time, but not to
exceed 30 days, after the date of said
declaration. An Official Intent Declaration shall remain available for public
inspection until at least the day after the
issuance of the Bonds from which the
prior expenditures are to be reimbursed,
and shall be made available to the Bond
counsel for that issue.
It is the intention of the Board that an
Official Intent Declaration shall be made
only if, as of the date of the declaration,
the District reasonably expects that it
will reimburse, the expenditure with Bond
or borrowing proceeds. The Board understands that the determination as to
whether the expectation to reimburse is
reasonable is based on all relevant facts
and circumstances, including the purpose for the declaration, the history of
actual reimbursement of other expenditures for which official intent was declared and which were actually paid,
and the Districts actions taken toward
reimbursement of the expenditures.
3. Reimbursement Period Requirement. The administration shall advise
the Board from time to time on timing
issues relating to reimbursements for
which Official Intent Declarations have
been made including recommendations
on the timing of the issuance of Bonds
so that the reimbursement allocations
occur not earlier than the dates on which
the expenditures are paid and not later
than eighteen (18) months after the later
of (a) the date on which the expenditure
is paid or (b) the date on which the
property is placed in service or abandoned (but in no event more than three
(30 years after the original expenditure,
except as provided in Treas. Reg. 1.1502(2)(de)(ii) and (iii). The officials designated above to make the Official Intent
Declarations shall also be responsible
for making the appropriate reimbursement allocations to reimburse the source
of temporary financing used by the District to make the payments for the prior
expenditures. Each allocation shall be
evidenced by an entry on the official
books, records, or accounts of the District maintained for such reimbursement
Bonds; shall specifically identify the actual prior expenditure being reimbursed
or, in the case of a reimbursement of a
particular fund or account, the fund or
account from which the expenditure was
previously paid. This allocation shall be
effective to relieve the Bond proceeds
involved from any restrictions under the
Bond resolution or other relevant legal
documents for those Bonds and under
any other state statute applicable to
unspent proceeds of that Bond issue.
4. Capital Expenditure Requirement.
a) General. An original expenditure
to be reimbursed from Bond proceeds
must be a capital expenditure, a cost of
issuance for a Bond or an expenditure
defined in the applicable Treasury Regulation.
b) Capital Expenditures. The term
capital expenditure as used in the
Regulations means any cost of a type
that is properly chargeable to a capital
account. Whether an expenditure is a
capital expenditure is determined at the
time the expenditure is paid. Capital
expenditures do not include expenditures for items or current operating expense that are not properly chargeable
to a capital account. Costs incurred to
acquire, construct or improve land, buildings, and equipment generally are capital expenditures. Under the Regulations, the issuance costs of issuing reimbursement Bonds are also treated as
capital expenditures.
c) Preliminary Expenditures. The Official Intent Requirement does not apply
to preliminary expenditures that are reimbursed with proceeds of a Bond that
finances all or a portion of the property,
project or program with respect to which
the preliminary expenditures were incurred. The term preliminary expenditures includes architectural, engineering, surveying, soil testing, reimbursement Bond issuance, and similar costs
that are incurred prior to commencement, rehabilitation or acquisition of a
property, project or program, but does
not include land acquisition, site preparation and similar costs incident to commencement of construction. Preliminary expenditures include only amounts
that do not exceed in the aggregate
twenty percent (20%) of the issue price
of that portion of a Bond issue or Bond
issues that finance the property, project
or program with respect to which the
preliminary expenditures were incurred.
d) Transition rule Expenditures. The
official Intent Requirement also does
not apply to certain expenditures paid
by the Issuer if the expenditures comply
with the transition rule provisions of the
Regulations.

FACILITY UPDATE: Krause Anderson
just sent a timeline that Champa handed
out to the board. We are entering into a
new phase of the project. Because of
the magnitude of the project, we need to
decide if the same committee should be
used or should we change the membership. Warneke opened up his spot.
Champa outlined what he thought the
boards responsibility should be going
forward on the project. Hayden volun-

teered his expertise for the construction


communication aspect. The board would
like 3 board members to be at each
meeting every Wednesday at 5:00. Fall,
Champa, and Hayden will be the representatives. Others will fill in as needed.
At the end of each board meeting, the
meeting will reconvene in the district
conference room to be able to meet
around the table and check out drawings, etc. Bids for precast will be going
out shortly. Groundbreaking will be toward the end of August to be on schedule for opening in September of 2015.
ADVISORY TEAMS AND BOARD INVOLVEMENT: This Wednesday pre-k
through 4 will have a meeting for discussion on the new building. Roles for the
advisory teams were reset and confirmed.

- Heiden, Champa, Hayden; 5-12 school
- Fall, Warneke, and Heiden.
COMMITTEE REVIEW-NEGOTIATIONS:
Principal, cabinet, and non-licensed negotiations will be taking place. Fall would
like to come off the committee. Champa
asked for someone to fill in. Warneke
volunteered. Our goal is have negotiations done by July 1. Bailey, Heiden,
and Warneke will be the new team.
TEACHER ON SPECIAL ASSIGNMENT
RECOMMENDATION: There is a reduction of 2.153 FTEs. Were expecting our
integration plan for this summer. We
are looking at a dean/curriculum/integration and achievement position in the
middle school. There is no specific
grade level. Were looking at what might
work best. We have no definitive answer right now. We could try it for this
next year and see what works. Grant
writing may be included in the position.
Half would be through the integration
grant. Motion by Warneke, seconded by
Douglas to approve the recommendation to hire a teacher on special assignment. Motion carried 6-0. We will advertise internally first.
HIGH STUDENT ACHIEVEMENT
A. COLLABORATION AND COMMUNICATION COMMITTEE REPORT: Margie
Berg was not able to be present.
B. EFFECTIVE AND EFFICIENT COMMITTEE REPORT: Mr. Strandell presented
to the board. A couple of highlights are
suggestion box comments and concession issues. Mr. Douglas has joined the
committee. Items discussed include
snow removal issues, technology issues,
transportation, calendar, fire marshall
and OSHA, possibility of wifi on the buses,
and legislature updates. They elected
Jackie Walter as chair, Kelly Barker as
vice-chair, and Kelli Rasmussen as secretary. Reduction in insurance costs for
employees was discussed at the last
meeting.
C. SHAWN ERICKSON PRESENTATION:
He gave a quick review of the PI Ag
program. He reviewed what has been
done this last year. They received a
plaque for contributing over $40,000 to
Camp Courage over the years. He introduced his student teacher, Heidi Dudley.
One project started was the FFA Clay
bust. In June Shawn will be attending
some curriculum training for next year.
Its the agricultural side of Project Lead
the Way and is through a grant from
RAMSP.
D. COMMUNITY EDUCATION PRESENTATION: Kelly Barker presented to the
board. She reported on numbers for
school readiness and events. She
complimented Beau and his crew for
the great ice rink. They are introducing
a STEM component to the summer program. They became a 4 star parent
aware program this year. She reported
on new offerings for the year.
E. K-8 PRINCIPAL REPORT - Cindy
Hansen reported about RTI time coming
up in the middle school for next year.
We will be finishing the teacher evaluation pilot in the fall. Clean up Day was
changed a little. They helped elderly
citizens and cleaned up the parks. Jump
Rope for Heart raised over $9000. The
8th grade celebration will be June 5 at
11:15.
G. HEAD GIRLS BASKETBALL COACH
RECOMMENDATION: Motion by Warneke,
seconded by Hayden to approve Mr.
Andersons recommendation of Scott Miller
as Head Girls Basketball Coach. Motion carried 6-0.
H. HS LANGUAGE ARTS RECOMMENDATION: Motion by Heiden, seconded
by Warneke to approve Katherine Susa
as our HS English teacher. She is also
interested in the drama department.

I. MSHSL MEMBERSHIP: Motion by
Douglas, seconded by Hayden to renew
our membership in the Minnesota State
High school League. Motion carried 60.
COLLABORATIVE WORK ENVIRONMENT
A. STAFF APPRECIATION OPPORTUNITY: The superintendent suggested
having an end-of-year appreciation for
the staff. The board agreed.
B. CONCESSIONS STAND FOR SUMMER SOFTBALL AND BASEBALL: A family
is looking at purchasing a concession
stand. They wanted to make sure it would
be okay with the board. It would meet
state regulations. They would need a
permit. This would be an independent
venture. The school would not spend
any money or receive any money. The
board liked the idea since the games
are always at supper time. This might
be a good opportunity to see how it
goes. The superintendent will look into
it further. Bailey wanted to make sure
that everyone knew it would not benefit
the summer programs in any way. The
board thought it was a good idea and
would be reviewed yearly. Motion by
Douglas, seconded by Hayden to approve the summer use of the concession stand provided it meets the guidelines required. Motion carried 6-0.
D. NEGOTIATIONS AND AGREEMENTS
UPDATE: We need to set up a meeting
date.
E. CURRENT POSITION POSTINGS:

PROCESS: This is an annual event. The
timing of the evaluation was discussed.
Champa sent out forms and compiled
changes. The objective of this meeting
is to confirm were comfortable with the
form. Each member should independently rate the superintendent using the
form. The board was reminded that
part of the increase is pay for performance. Have the forms back to Champa
by June 2. It will be brought to the June
5th meeting. The summary will be brought
back to the June 16th meeting. Heiden
suggested that Beniak fill out a form
evaluating herself also for part of the
discussion.
J. SUPERINTENDENT REPORT: They
discussed the July 15th school board
meeting. If the meeting were changed
to July 10th, bond dollars would be
available in August; a July 15th meeting
will delay the bonds. Beniak recommended moving the board meeting to
the 10th. Well discuss at the next
meeting if we need another July meeting. There is a need to work on the 3rd
aim of the strategic plan. There is a
need to review all the measures of success possibly at a separate retreat. They
decided on June 5th at 5:00. We may
want to look at an open enrollment policy
and setting a cap. There is also a policy
looking at anonymous. Springsted has
contacted us wondering if we want to do
a referendum follow-up for $8800. It
was decided to not do it. We may need
to change next years calendar because
of the building project. Beniak reviewed
the legislative actions.

City of Wanamingo
2013 Drinking Water Report
The City of Wanamingo is issuing the results of monitoring done on its drinking
water for the period from January 1 to December 31, 2013. The purpose of this
report is to advance consumers understanding of drinking water and heighten
awareness of the need to protect precious water resources.
Source of Water
The City of Wanamingo provides drinking water to its residents from a groundwater source: a 600-foot-deep well that draws water from the Jordan-St. Lawrence
aquifer.
The Minnesota Department of Health has determined that the source(s) used to
supply your drinking water is not particularly susceptible to contamination. If you
wish to obtain the entire source water assessment regarding your drinking water,
please call 651-201-4700 or 1-800-818-9318 (and press 5) during normal business hours. Also, you can view it on line at www.health.state.mn.us/divs/eh/
water/swp/swa.

Results of Monitoring
No contaminants were detected at levels that violated federal drinking water
standards. However, some contaminants were detected in trace amounts that
were below legal limits. The table that follows shows the contaminants that were
detected in trace amounts last year. (Some contaminants are sampled less
frequently than once a year; as a result, not all contaminants were sampled for in
2013. If any of these contaminants were detected the last time they were sampled
for, they are included in the table along with the date that the detection occurred.)
Key to abbreviations:
MCLG_Maximum Contaminant Level Goal: The level of a contaminant in drinking water below which there is no known or expected risk to health. MCLGs allow
for a margin of safety.
MCL_Maximum Contaminant Level: The highest level of a contaminant that is
allowed in drinking water. MCLs are set as close to the MCLGs as feasible using
the best available treatment technology.
MRDL_Maximum Residual Disinfectant Level.
MRDLG_Maximum Residual Disinfectant Level Goal.
AL_Action Level: The concentration of a contaminant which, if exceeded,
triggers treatment or other requirement which a water system must follow.
90th Percentile Level_This is the value obtained after disregarding 10 percent
of the samples taken that had the highest levels. (For example, in a situation in
which 10 samples were taken, the 90th percentile level is determined by disregarding the highest result, which represents 10 percent of the samples.) Note: In
situations in which only 5 samples are taken, the average of the two with the
highest levels is taken to determine the 90th percentile level.
pCi/l_PicoCuries per liter (a measure of radioactivity).
ppm_Parts per million, which can also be expressed as milligrams per liter (mg/
l).
ppb_Parts per billion, which can also be expressed as micrograms per liter (_g/
l).
nd_No Detection.
N/A_Not Applicable (does not apply).

Organic chemical contaminants, including synthetic and volatile organic


chemicals, which are by-products of industrial processes and petroleum production, and can also come from gas
stations, urban stormwater runoff, and
septic systems.
Radioactive contaminants, which can
be naturally-occurring or be the result of
oil and gas production and mining activities.
In order to ensure that tap water is
safe to drink, the U. S. Environmental
Protection Agency (EPA) prescribes regulations which limit the amount of certain
contaminants in water provided by public water systems. Food and Drug Administration regulations establish limits
for contaminants in bottled water which
must provide the same protection for
public health.
Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some
contaminants. The presence of contaminants does not necessarily indicate
that water poses a health risk. More
information about contaminants and
potential health effects can be obtained
by calling the Environmental Protection
Agencys Safe Drinking Water Hotline at
1-800-426-4791.
Some people may be more vulnerable to contaminants in drinking water
than the general population. Immunocompromised persons such as persons
with cancer undergoing chemotherapy,
persons who have undergone organ transplants, people with HIV/AIDS or other
immune system disorders, some elderly, and infants can be particularly at
risk from infections. These people should
seek advice about drinking water from
their health care providers. EPA/CDC
guidelines on appropriate means to lessen
the risk of infection by Cryptosporidium
and other microbial contaminants are
available from the Safe Drinking Water
Hotline at 1-800-426-4791.

for pregnant women and young children. Lead in drinking water is primarily from
materials and components associated with service lines and home plumbing. City
of Wanamingo is responsible for providing high quality drinking water, but cannot
control the variety of materials used in plumbing components. When your water
has been sitting for several hours, you can minimize the potential for lead exposure
by flushing your tap for 30 seconds to 2 minutes before using water for drinking or
cooking. If you are concerned about lead in your water, you may wish to have your
water tested. Information on lead in drinking water, testing methods, and steps
you can take to minimize exposure is available from the Safe Drinking Water
Hotline or at http://www.epa.gov/safewater/lead.
Monitoring may have been done for additional contaminants that do not have
MCLs established for them and are not required to be monitored under the Safe

Compliance with National Primary Drinking Water Regulations
The sources of drinking water (both tap water and bottled water) include rivers,
lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the
surface of the land or through the ground, it dissolves naturally-occurring minerals
and, in some cases, radioactive material, and can pick up substances resulting
from the presence of animals or from human activity.
Contaminants that may be present in source water include:
Microbial contaminants, such as viruses and bacteria, which may come from
sewage treatment plants, septic systems, agricultural livestock operations, and
wildlife.
