Board of Adjustments & Appeals
January 14, 2015
The City Council of the City of Gretna sat this day on Wednesday, January 14,
2015 at 4:30 p.m. as the Board of Adjustments & Appeals with the following
Council members present: Wayne A. Rau, Milton L. Crosby, Jackie J. Berthelot,
and Mark K. Miller.
Absent: None
Presiding: Councilman Wayne A. Rau
Joseph A. Marino III entered the Council Chambers at 4:34 p.m.

Meeting notice of the Board of Adjustments & Appeals of the City of Gretna,
scheduled for Wednesday, January 14, 2015 was published in the New Orleans
Advocate edition on January 7, 2015 and was posted on the Gretna City Hall
bulletin board on Friday, January 9, 2015.

On motion by Councilman Berthelot and seconded by Councilman Crosby, IT
WAS RESOLVED to approve the November 12, 2014 Board of Adjustments &
Appeals meeting minutes, and the same was unanimously approved.
Properties for consideration:
517 Hancock Street (Shed in rear) Steven Oscar Marcour, Owner
Legal Description: Lot 15, Square 120, McDonoghville Sub.(Parcel #
0100001577)

At this time, Mr. David Greenberg duly appointed, Curator Ad Hoc appeared
before the Board of Adjustments & Appeals. Said Curator was duly appointed to
represent the procedural interests of the owners and/or parties in interest on the
above-described property and who with respect, represents: That upon being
served with the Notice of Appointment, said curator ad hoc did ascertain that
the titled owner to said property according to the Jefferson Parish Conveyance
Records is Steven Oscar Marcour. Steven Oscar Marcour acquired title to this
property by Judgment of Possession dated September 26, 2006 and recorded at
COB 3175, folio 433 of the Conveyance Records of Jefferson Parish.
On December 16, 2014, undersigned curator wrote to the owner of this property,
Steven Oscar Marcour.
In addition, the following ad was placed in the Times Picayune on December 28,
29 and 31, 2014, seeking to learn the whereabouts of the Steven Oscar Marcour.
Steven Oscar Marcour, or his heirs or anyone knowing his whereabouts,
please contact David Greenberg, Attorney at Law, 848 Second Street, Suite 200
Avenue, Gretna, Louisiana 70053 (504) 366-8118. Property rights involved.
Undersigned curator did not hear from Mr. Marcour in spite of these attempts
to reach him.
Further, that according the abstract ran on this property, that there is a mortgage
recorded against this property in favor of Jefferson Parish School Board
Employees Credit Union recorded at MOB 4362, folio 103 of the mortgage
records of Jefferson Parish, Louisiana. Undersigned wrote a letter to Jefferson
Parish School Board Employees Credit Union through its counsel of record,
Robert Contreras on December 16, 2014. A copy of the letter together with
the green card evidencing receipt was received by this office.
Undersigned curator received no response as a result of the above attempt to
communicate with Jefferson Parish School Board Employees Credit Union
through its attorney of record, Robert Contreras.
That according to the abstract and Hogan Certificate ran on this property, there
is a tax sale purchase against this property recorded at MOB 3335, folio 422
of the Mortgage Records of Jefferson Parish in favor of Stephanie Dieterich.
Accordingly, the following ad was placed in the Times Picayune on December
28, 29 and 31, 2014, seeking to learn the whereabouts of the Stephanie Dieterich.
Stephanie Dieterich, or her heirs or anyone knowing her whereabouts, please

On January 14, 2015, undersigned curator received a telephone call from an
individual by the name of Zack Dietrich, the son of this tax sale purchaser,
Stephanie Dieterich. He indicated that he had attempted to contact the owner
of this property to attempt to purchase the property from him and learned that
the owner, Steven Oscar Marcour, is currently unavailable and that his mother,
Hilma Olson Desentz, is handling his affairs. Mr. Dietrich gave undersigned
curator two telephone numbers to attempt to reach Ms. Desentz. Undersigned
curator left a message for her but has not yet heard back from her.
In addition, there are certain inscriptions on the certificate in favor of the City
of Gretna who is a party to this proceeding and thus, has actual notice of said
proceeding.

That in doing the foregoing said curator ad hoc stated that know of no reason
why this matter cannot move forward at this time, has completed his duties in
this matter, and files this Note of Evidence herein.
Building Official Report
The recommendation by the Building Official is that the structure be approved
for demolition due to:
Health and Life Safety issues
Structurally unsound
Public nuisance
Insanitary conditions
Inadequate means of egress facilities
Inadequate light and ventilation
Constituting a fire hazard
Danger to human life or public welfare
Inadequate maintenance
October 17, 2014 - The Building Official sent a Notice to Abate for the unsafe
conditions of the property due to further neglect visible from exterior inspection
November 24, 2014 Proper time had passed with the Notice to Abate and the

January 8, 2015 The Building Official and Building Department have not
received any contact or communication from the owner of record since the
sending of Notice to Abate to present.
In addition, the Building Official recommended that if the owner wishes to
rehabilitate the structure, the following information would need to be addressed
for insurance purposes that would affect the City and before the issuance of a
permit.
Due to National Flood Insurance Program (NFIP) standards, the fair market
value of the structure will need to be provided minus the land before Hurricane
Katrina.
A Louisiana State Licensed/Registered Contractor will need to provide the
scope and value of the work that will be performed.
NFIP states that if the work exceeds 50% of the fair market value of the original
structure then the structure must be upgraded to meet the current floodplain
standards.
ABFE standard, elevating the structure to 3-0 above adjacent grade, base flood
elevation or crown of street, whichever is higher.
On motion by Councilman Crosby and seconded by Councilman Miller, IT WAS
RESOLVED to accept the Notes of Evidence presented by Mr. David Greenberg,
Curator Ad Hoc and to approve the recommendation of the Building Official to
demolish the structure at the rear of the property located at 517 Hancock Street
(Shed in rear), by the following vote:

At this time, Mr. David Greenberg duly appointed, Curator Ad Hoc appeared
before the Board of Adjustments & Appeals. Said Curator was duly appointed to
represent the procedural interests of the owners and/or parties in interest on the
above-described property and who with respect, represents: That upon being
served with the Notice of Appointment, said curator ad hoc did ascertain that
the titled owner to said property according to the Jefferson Parish Conveyance
Records is Emad Nowa Quran, a/k/a Emad Ndwa Quran (Quaran). Emad Nowa
Quran acquired title to this property by Act of Donation dated April 24, 2001
and recorded at COB 3051, folio 137 of the Conveyance Records of Jefferson
Parish.
On December 16, 2014, undersigned curator wrote to the owner of this property,
Emad Nowa Quran, a/k/a Emad Ndwa Quran (Quaran). In addition, a copy of
this letter was mailed to Joseph A. Marino, Jr., as a curator in the foreclosure of
the above described property.
Accordingly, the following ad was placed in the Times Picayune on December
28, 29 and 31, 2014, seeking to learn the whereabouts of Emad Nowa Quran,
a/k/a Emad Ndwa Quran (Quaran):
EMAD NOWA QURAN, A/K/A EMAD NDWA QURAN (QUARAN), or
his heirs or anyone knowing his whereabouts, please contact David Greenberg,

On December 30, 2014, undersigned curator received a telephone call from
Joseph Marino, Jr. Mr. Marino supplied undersigned curator with an additional
address for Ms. Quran. Undersigned curator sent an additional letter to Ms.
Quran. This letter has been returned by the United States Post Office as
undeliverable. Undersigned curator avers that despite these attempts to reach
the property owner, Ms. Quran that he has not heard from her.
Further, that according the abstract run on this property, that there is a mortgage
recorded against this property in favor CitiFinancial Servicing, LLC formerly
known as CitiFinancial Consumer Services, Inc. recorded at MOB 4231, folio
308 of the mortgage records of Jefferson Parish, Louisiana. Undersigned
wrote a letter to CitiFinancial Servicing, LLC formerly known as CitiFinancial
Consumer Services, Inc. through its counsel of record, David Hugenbruch on
December 16, 2014. A copy of the letter together with the green card evidencing
receipt was received by this office.
Undersigned curator received no response as a result of the above attempt
to communicate with CitiFinancial Servicing, LLC formerly known as
CitiFinancial Consumer Services, Inc. through its attorney of record, David
Hugenbruch.
In addition, there is a Notice of Habitation recorded in the Conveyance Records
of the Parish of Jefferson, State of Louisiana. Undersigned curator wrote a letter
to Dennis Kass on December 16, 2014. The letter returned as Mr. Kass is no
longer living at the subject property.
That according to the abstract and Hogan Certificate ran on this property, there
are no unredeemed tax sales recorded against this property.
In addition, there are certain inscriptions on the certificate in favor of the City
of Gretna who is a party to this proceeding and thus, has actual notice of said
proceeding.
That in doing the foregoing said curator ad hoc stated that know of no reason
why this matter cannot move forward at this time, has completed his duties in
this matter, and files this Note of Evidence herein.

RESOLVED to accept the Notes of Evidence presented by Mr. David Greenberg,
Curator Ad Hoc and to approve the recommendation of the Building Official to
demolish the structure at the rear of the property located at 1518 Newton Street
(Shed in rear), by the following vote:
Yeas: Councilmen Miller, Crosby, Marino and Berthelot
Nays: None
Absent: None
Presiding: Councilman Wayne A. Rau
On motion by Councilman Crosby and seconded by Councilman Miller, and
unanimously approved, the meeting adjourned at 4:39 p.m.

INTRODUCTION OF ORDINANCES

The following ordinances will be considered for adoption by the City Council of
the City of Gretna at a Public Hearing on Wednesday, June 10, 2015 at 5:30 P.M.,
Mayor and Council Regular meeting at Gretna City Hall, 740 Second Street,
Gretna, Louisiana, 2nd Floor Council Chambers.

An ordinance to amend the Gretna Code of Ordinances, amending Chapter
90, Traffic and Vehicles, Article II-Administration and Enforcement, Division
2, Vehicle Towing and Impoundment Section 90-51. - Removal of vehicles
from streets; impoundment - and Section 90-54. Time delays for towing of
abandoned vehicles.

An ordinance approving the resubdivision of Lots B-2, C and D-3, Holmes Place
Subdivision, Gretna, Louisiana INTO Lot C-1, Holmes Place Subdivision, as
per the plan of survey and resubdivision of Dufrene Surveying and Engineering
Inc., dated August 21, 2014.
An ordinance declaring vehicles and equipment surplus property, and no longer
needed for public purposes and to authorize sale of said property at a public
auction.

An ordinance providing for the incurring of debt and issuance, execution,


negotiation, sale and delivery of One Million Dollars ($1,000,000) of Limited
Tax Revenue Bonds, Series 2015 (the Bonds), of the City of Gretna, State of
Louisiana; prescribing the form, terms and conditions of the Bonds; designating
the date, denomination and place of payment thereof in principal and interest;
authorizing the agreement with the paying agent; providing for the acceptance
of an offer for the purchase of the Bonds; and providing for other matters in
connection therewith.

An ordinance in accordance with Louisiana Revised Statute 33:404.1, setting


the compensation for the positions of Mayor and Chief of Police at less than the
mean salary of $96,092.00 for cities of comparable size and population in the
State of Louisiana and in the amount of $90,000 annually to become effective
July 1, 2015.

An ordinance amending Ordinance No. 1945 of the City of Gretna, adopted


by the City Council of the City of Gretna on the 12th day of July 1989,
more particularly amending the zoning classification of Lot F, Square 99,
McDonoghville Subdivision, Gretna, Louisiana, from R-1 (Single-Family
Residential) to C-1 (Neighborhood Commercial) and directing, authorizing and
empowering the Planning and Zoning Official of the City of Gretna to alter and
amend the Official Zoning Map of the City of Gretna.
