Subject: Information to Conduct Relocation Survey

Dear Hon. Mayor Benemerito:

Greetings!

In spite of your continued denial to my request to conduct relocation survey as it


is being stated to your letter dated November 27, 2021, I just want to reiterate once and
for all to formally inform your good office relative to the Municipal Ordinance No.
2000-02, which states that “An Ordinance Requiring any Lot Owners and Surveyor
within the Municipality to Inform (emphasis ours) the Assessor’s Office and Mayor’s
Office before they conduct any survey Hereat”, that our Survey Team headed by Engr.
Gregorio Malacas shall conduct relocation survey on January 16-18 ,2021 on the
following lots covered by PSU 45960 Amd. II to wit:

1. Lot 1-D, with an area of 34,785 square meters


2. Lot 1-E, with an area of 42,250 square meters
3. Lot 1-F, with an area of 30,675 square meters
4. Lot 4-B, with an area of 28,094 square meters
5. Lot 4-C, with an area of 22,863 square meters
6. Lot 4-D, with an area of 269 square meters
7. Lot 4-E, with an area of 35,291 square meters
8. Lot 4-F, with an area of 17,649 square meters
9. Lot 4-G, with an area of 38,505 square meters
10. Lot 2-B, with an area of 137,187 square meters
11. Lot 3-B, with an area of 83,057 square meters and
12. Lot 5-B, with an area of 65,199 square meters.

I have sought legal advice and as far as the Municipal Ordinance is concerned, we
are of the opinion that we are not mandated to seek permission from your good office
for the conduct of relocation survey of private lots. It is very clear that the ordinance
only obliges lot owners to inform the Mayor’s office before taking such action. Unless
your good office can present an ordinance which expressly grants you the authority to
prevent lot owners from taking relocation surveys, I have decided to push through with
the said action on the belief that it is within my legal right to assert.

As per the Extrajudicial Settlement of Surviving Heirs with Special


Power of Attorney being submitted to your office on November 25, 2020 for
your reference and guidance that the undersigned is the duly authorized representative
of the applicants re: June 14, 1977 court Decision as per L.R. Case No. N-127, LRC
Record 39943. Any dispute among us, the applicants and heirs if there is any shall be
our own responsibility to settle among ourselves. Being the authorized representative I
also respect Mr. Cornelio Castillo Jr. and Ms. Vanessa Rejuso as one of the living heirs of
their deceased parents who one among the applicants to the above mentioned LRC Case.

The undertaking that we are only legally obliged to inform you shall be
collectively for the benefit of all applicants and heirs not withstanding whether or not
said activity is being requested by any one from us the concerned, applicants, heirs and
authorized representative.

What we are seeking is your cooperation as being the Chief Executive of the Town
as per the above stated Municipal Ordinance 2000-02.

We are hoping that the aforementioned shall be given your utmost preferential
attention so that we could delineate the properties to be assigned to each and every
applicant and/or legal living heirs which could settle any disagreement amongst us.

Thank you and hoping for your prompt action and consideration on the matter
aforementioned. More power to you.
