AFFIDAVIT OF DESISTANCE

I, _____________________, Filipino, of legal age, single/married and a

resident of the City of Koronadal, South Cotabato, after having been duly sworn
to in accordance with law, hereby depose and say:

1. That I am the Private Complainant in CRIMINAL CASE No. _______

for _____________________ filed against __________________ now
pending before the Municipal Trial Court in Cities, City of Koronadal,
South Cotabato;

2. That I am no longer interested in the further prosecution either

criminal or civil in nature against __________________ as I have
already come up with an acceptable settlement of this case;

3. That because of this, I will no longer pursue any proceedings in the

said case and I will not testify against the above named accused in the
said case, and in any other tribunal, body or agency;

4. That I am executing this affidavit to attest to the truth of all the

foregoing and to make an express manifestation of my intention to
desist from further participation in the proceedings for the above
mentioned case against ELAN APOSAGA and RICHARD FORRO.
