THE ROLE OF POLICE IN CASES OF SEXUAL ABUSE


OF CHILDREN AND THE YOUTH

Abstract: Comparing the number of cases of sexually abused children with the number of other sexual-related crimes, we can conclude that this kind of sexual abuse
should not be underestimated, as it can seem to those claiming that these are only
sporadic crimes. In addition to this, this is characteristic for urban environment primarily. Police in urban environment play decisive role in preventing and suppressing these deviances. In order to deal with this kind of delicts, we require a detailed
analytical approach, timely observation of potential perpetrators, knowledge of their
modus operandi, detection of potential victims, education of citizens to identify perpetrators, procedure with perpetrators and their victims and many other relevant
issues related to this problem. One of the preconditions in implementation of such a
conceived preventive programs is adequate police training and education of all participants in prevention and suppression of sexual abuse of children. Moreover, it is
necessary to build an entire system of informing in order to activate all associations
of citizens and predict all available forms of communication within a local community. The goal is clear: supervision and control of places where potential perpetrators appear, educating citizens on their modus operandi (delinquent tactics), giving
adequate information to children so that they would avoid potential perpetrators,
timely reporting of every case to the police and adequate response and acting in
cases of run-away or missing children.
There is no doubt that there is great preventive potential in inadequately used possibilities of the local community. It is therefore necessary for the local community
to organize in an appropriate manner, both professionally and socially, against this,
unfortunately increasingly frequent problem with the goal of preventive and repressive action, primarily its prevention.

Abstract: The paper presents conceptual and strategic approach to counteracting terrorism as one of the greatest threats to planetary (global) system of security. We have
started from legal documents related to foreign and security policies (conventions,
and similar), which are intended for establishing of a generally and internationally
accepted concept and strategy of counteracting transnational terrorism. There is
also the analysis of the essential question whether terrorism should be treated as
a non-military risk and threat, i.e. as crime through establishing of strategies of
institutional and legislative opposition at international, regional and national level,
or whether it should be treated as a military challenge and threat (the problem of
collective and national defense) through establishing of the concept of preventive war against terrorism. Starting from that, we have presented several mutually
various regional and national approaches to creation of security policy of fighting
against terrorism, as a key sign-post and foundation of practical fight against terrorism. These are the concepts of the European Union, the United States of America
and the Russian Federation, with a short survey of the current situation in Serbia
and Montenegro.

MAIN CHARACTERISTICS OF NEW LAW OF DELICT

Abstract: In November 2005, new Law of Delict was adopted, which brought important novelties in our delict-related legislation, both in its material and procedural
parts. To pass a new law of delict was necessary for many reasons, primarily because
of the need for additional adjustments following the discontinued use of Law on
Delict that used to break federal regulations, but also because of the adjustments
with the international regulations and newly-adopted regulations of criminal material and procedural legislation. Due to the necessity to adjust other delict regulations
with the new Law of Delict and the need to constitute new police courts, as well as to
make certain organizational and technical preparations, the application of the new
law was postponed for January 01, 2007.
The most important changes in material part of the new law refer to introduction of
the notion of delict and delict liability, as well as to the introduction of new penalties: work in public interest and penal points as punishment, forbidding the access
to the injured party, facilities or the place where the delict was made and public announcement of the sentences as protective measures, and so-called special measures
as correctional measures towards juveniles. As for the delict procedure, the most important novelties refer to institutions leading the procedure, especially introduction
of police courts as completely new institutions within our judicial system, but also
to the bigger role of public prosecutor, strengthening of the principle of initiation
of delict procedure, measures to ensure the presence of the accused, reaching the
verdict instead of decision on the delict, et cetera.

CRIMES AGAINST SEXUAL INTEGRITY


IN CRIMINAL LEGISLATION OF REPUBLIKA SRPSKA

Abstract: The latest reforms of criminal legislation in Republika Srpska have brought
considerable changes in regulations regarding sexual-related crimes. The main characteristic of these changes is de-criminalization of all kinds of behavior in the sphere
of human sexuality which is consensual and which is carried out between adults, on
the one hand, and strengthening of criminal and legal protection of sexual integrity
of children and minors, on the other hand. In addition to this, new concept of rape
has been accepted, according to which rape is qualified as any case when sexual intercourse or other sexual activity that can be made equal with sexual intercourse by
its effects, is carried out against the will (without consent) of a passive subject. The
earlier sexual and marital discrimination based on the rule that only a man can be
perpetrator and that only a woman with whom the perpetrator does not share marital community can be passive subject, has been abandoned, and sexual blackmail
has been introduced as a special form of rape. All this points to the conclusion that
criminal zone of rape is widened considerably, which led to abolishing of certain
incrimination absorbed by this crime (for instance, unnatural debauchery, forced
sexual intercourse).
Tendency to widen and strengthen criminal and legal protection of sexual integrity
of children and minors has been realized by an increased number of incriminations.
The author particularly points out to that effect the crime of sexual violence of a child
(Art. 195), as quite a new incrimination which provides for optimum protection of
a childs sexual integrity, then to satisfying ones sexual passion in front of another
person, as well as certain crimes that do not represent completely new legal solutions
but still bring certain novelties in our legislation such as: trafficking in humans for
the purpose of prostitution, abuse of children and minors for pornographic purposes and production and publication of child pornography.

Abstract: The paper undoubtedly determines the content of the notion non-lethal
weapons. It starts from determining the validity of the existing definitions of nonlethal weapons in comparison with the requirements for a valid definition. After that,
basic features of non-lethal weapons are determined, in order to come to the core of
the subject of definition. Finally, the new valid definition of non-lethal weapons as
specific means of coercion is deducted.

HUMAN TRAFFICKING AS A FORM OF ORGANIZED CRIME MAIN

Abstract: Human trafficking is a complex socio-pathological phenomenon based on
(historical) institutions of slavery and exploitation, i.e. on treating a man as goods or a
thing, in order to exploit his labor power, knowledge and skills, bodily and sexual integrity in order to satisfy ones own or someone elses instinct, health or emotional needs or
in order to gain direct or indirect material profit for oneself or somebody else.
Certain forms of slavery and exploitation of persons known from ancient times can
be seen today in identical form (public selling of victims, working exploitation in
agricultural and home sector, sexual exploitation, forced participation in armed
conflicts) or in modified forms (working exploitation in industrial sector, illegal
adoption), and there are completely new forms (trafficking in human bodily organs
or parts, performing medical experiments, forced pregnancy, and similar). On the
other hand, manifesting forms of human trafficking do not differ in practice from
some other similar phenomena, primarily smuggling of migrants, prostitution and
work of illegal migrants in so-called black economy sector. This is why it has been
pointed to the main features of this phenomenon.
The conclusion is that human trafficking is a multi-manifesting phenomenon, and
this is why it is very difficult to come to a comprehensive, generally accepted classification of its manifesting forms. The offered classification of forms of human trafficking according to the degree of social danger, geographical level of implementation,
physical and biological characteristics of victims and relation of victim to his/her
position, in principle, does not exclude the possibility of some other classification.
The cases of human trafficking in practice can almost always be identified as some of
possible combination of previously mentioned forms and types.
In addition to being a multi-manifesting, human trafficking is also a multi-structural
phenomenon. The process of its realization, in principle, consists of four stages with
many sub-stages within each of them. The dominant moments in realization of human trafficking are certainly recruiting of victims, their transport, exploitation and
elimination.
Finally, human trafficking is exceptionally developed and represented activity of
organized criminal groups, more and more often transnational in scope. Excessive
demand for sexual services increased the excessive demand for the victims of trafficking, but also the division of jobs among criminal organizations, their specialization and tendency to create monopole position at human market, which is more
and more characterized by marketing, work of agencies, rules of business operations
and other epithets of modern economic management. There are huge possibilities of
profit since the victims can be exploited in many various ways.
The knowledge of the main characteristics of certain forms of human trafficking is an
important condition to identify these complex and dynamic phenomena in practice,
then to distinguish the human trafficking from other similar security problems as
well as to identify active and passive subjects in human trafficking.

Abstract: Following the end of the Cold War, uprisings experience their renaissance
and transformation getting enraged all over the world, especially in chronic centers
of crises and zones of tension. Armed uprisings have changed their ideological matrix and religious pattern begins to dominate their manifestation, or to be more precise, their leaning on religious and fundamentalist groups that are deeply connected
with nationalist political platform is characteristic. The new trend is confirmed also
by characteristic symbiosis between religion and ethnic separatism characteristic for
the Balkans, Caucasus, Punjab and Cashmere. Within the new military-political and
security environment, they become increasingly intertwined, connected and merged
with terrorism, organized crime and other forms of violence. During the post-communist period, many uprisings were predominantly religious in character or were
more pronouncedly connected with illegal trade or crimes than the previous, primarily political and revolutionary-oriented uprisings.

MARKETORIENTED BUSINESS PRACTICE OF THE EU

Abstract: The policy of competition represents one of the most important segments
of the activities of the EU bodies on the establishing and preservation of a unique
internal market. It represents a necessary addition to measures the goal of which
is to achieve basic principles on which functioning of a unique market is based: 1)
free movement of goods and services; 2) free movement of people labor power; 3)
free movement of capital. While the stated measures aim at removing various state
obstacles to free trade among the member states, the measures within the policy of
competition should remove the limitations to functioning of market mechanism of
the EU, which originates from the very participants of the market game. The competition policy as such, since the origination of the idea of the EU until its formal legal
foundation in 20th century, makes a continuous part of communitarian law.

made a separate NATO-Russia Action Plan on Terrorism so that this big country
would also be included directly in the front of these countries.
