Reflection
This was an eye-opening research assignment. I have always had a strong opinion on my
topic, pre-employment drug screening; specifically, due to privacy and HIPAA issues. I feel
passionately about employee rights and hope to see a lot of power given back to the American
worker.
The most important thing I learned in my research is that the laws that are protected by
the constitution with regard to any employment requirement but including drug screening only
pertains to government involvement and/or government employment. State laws are what
determines how pre-employment procedures and operations are executed, so in that light, there is
I honestly hope that the EEOC continues to take a look at these kinds of issues maybe
in this case its cause for Federal regulation to supersede state laws.
