General Terms and Conditions

When contracting with Joli Creations & Designs, hereinafter referred to as “Joli Creations & Designs” or the “Company”,
the hirer or purchaser of goods and services, hereinafter referred to as the “Client”, agrees to purchase floral
arrangements, hire “Hire Items” and purchase “Purchase Items” and services subject to the following conditions.

1. Provisional Booking or Quotes

All tentative bookings or quotes with/from Joli Creations & Designs will be held for a period of 7 working days. After this
time the date will not be held and you will need to re-book.

2. Confirmation of bookings, Final Payments & Changes

2.1 To confirm your booking with Joli Creations & Designs we require a 50% deposit. By paying the deposit for your
event, the client agrees that once paid, the deposit is now non-refundable.

2.2 Joli Creations & Designs expects final balance of account including security deposit within 14 days prior to the event
and can be paid by direct EFT deposit. Once full payment has been made it is now non-refundable (excluding Security
deposit).
2.3 Definite numbers and requirements are to be finalized 14 days prior to the event date.

3. Cancelations.
If cancellations occur inside the 14days from intended event date, full balance is non-refundable.

4. Security Deposit
A reservation deposit and security deposit may be required to be paid to Joli Creations & Designs. Any form of payment to
Joli Creations & Designs is deemed as acceptance of all of the terms and conditions of this agreement, thereby confirming
the Clients order. Where applicable, and at the sole discretion of Joli Creations & Designs, the security deposit will be
refunded to the Client after the safe return and inspection of all hire items. In case of loss or damage, Joli Creations &
Designs will deduct from the security deposit the amount needed to replace lost or damaged items. If the loss or damage
exceeds the amount of the security deposit, The Client agrees to pay the additional costs charged by Joli Creations &
Designs for these losses and damages within 7 calendar days.

5. Weather
In event of extreme weather conditions preventing you from holding your event at the requested outdoor site, money will
not be refunded. However Joli Creations & Designs will do their best to set up and coordinate your flowers and any hire
equipment to your ceremony at an alternative location of your choice. In an emergency like this, a minimum of 7hrs
notice would be needed to accommodate your change of plans. In the unfortunate event that this may take place, the
client understands the risks of choosing to hold their ceremony in an outdoor location and will not hold Joli Creations &
Designs responsible for anything that may not go to plan. Joli Creations & Designs reserves the right to refuse the setting
up certain hire equipment, in the event of extreme winds, Joli Creations & Designs has the right to refuse set up if we
deem its unsafe for the general public or our equipment.

6. Hiring
6.1 The Client is responsible for the hire items. Therefore if damage occurs, the Client will be liable for the subsequent
costs.
6.2 The rental period for hired items is for 1 calendar day unless stipulated otherwise. Late returns will be charged for at
a full additional hire.
6.3 Joli Creations & Designs reserves the right to refuse the use of outdoor decoration items in the event of adverse
weather conditions where their use could affect their integrity or cause harm to others.

7. Loss/Damages
All items remain the property of Joli Creations & Designs (excluding fresh flower arrangements unless specified
otherwise). Clients will be charged for the loss or damage of any items. Cost of loss or damaged items will be outlined in
your invoice. The payment for lost or damaged items will be taken out of your security deposit at the price outlined in
your invoice for loss or damage of the equipment you have hired.

8. Special care

Joli Creations & Designs supplies delicate and fragile items and arrangements that require special handling to avoid
damage. Special attention needs to be paid to avoid chipping, scratching and breakage. Please treat all hired items as you
would your own and avoid loss and damage that may be charged for. If during the hire period, the Client moves, adjusts,
rearranges or removes floral displays installed by Joli Creations & Designs, the Company accepts no liability whatsoever
for any loss, damage or injury sustained by the Client, or any other parties resulting from such activities.

9. Flowers
9.1 At all times the Company will endeavour to get the colours of flowers as close to Client’s chosen colour, but in some
circumstances due to seasonal changes and greenhouse effects Joli Creations & Designs will not be held responsible
should colour vary from Client’s first decision.
9.2 As fresh flowers and foliage are living products, there are occasions when particular varieties may be unavailable.
Whilst every effort is made to source products accordingly, sometimes Joli Creations & Designs is unable to obtain a
particular type of flower.

9.3 All fresh flowers and foliage are subject to availability and stringent quality checks; as such Joli Creations & Designs
reserves the right to use a similar flower in place of the previously chosen flower.
9.4 The customer is required to report any allergies to flowers.
9.5 Joli Creations & Designs will always endeavour to meet the Client’s specification for floral work but accepts no liability
for losses where this is not possible due to weather, transport, handling or other factors beyond our control.
We recommend that the Client discusses alternatives with us at the time of quoting and ordering to cover such an
eventuality.

9.6 Bouquets and Boutonnieres to be collected at place of set up by the client. Extra traveling costs may be charged
afterwards in case of the company delivering the bouquets and boutonnieres ext. at an another location.

10. Mock/ Sample Styled Table

10.1 Client may request a sample table from the company.
10.2 The client is responsible to pay for any flowers use and will be charge accordingly. Décor items will not be charged.
10.3 Availability of flowers may vary depending on mock date and some flower sorts may not be available at time of
mock.

11. Set Up and Breakdown

11.1 Labour will be charge based on information provided by the client. In case of changes made to the set up date and
time, Joli Creations and Designs have the right to charge accordingly. All charges on quote or invoice are based on
business hours between 8 am and 5 pm. After hour setup and breakdown including Sundays and public holidays will be
charged extra. Please note this is the client’s responsibility to establish the best setup and breakdown date and time with
the venue. Please make sure to provide accurate information to the company to avoid extra charges. Date and times may
change latest 21 days before the function date. Joli Creations and Designs will then update invoice accordingly.

12. Safety guidelines pertaining to floral items

It is the Client’s responsibility to inform his guests and event members provided with floral items from Joli Creations &
Designs of the following warnings:
12.1 Pin on corsages and buttonholes are attached to material with a pin, care must be taken when affixing pin on
corsages and buttonholes as pins are sharp. If the wearer believes the pin could damage the material in their outfit, then
the corsage/ buttonhole should not be affixed to the outfit.
12.2 Magnetic corsages and buttonholes must not be worn by or near anyone with a pacemaker device.
12.3 Flowers are delicate items, and must be handled with care. Some vibrantly coloured blooms, and greenery can cause
staining, it is therefore important that flowers are not crushed against clothing.
12.4 Children must be supervised at all times when they have flowers including floral baskets, wands, hair accessories,
buttonholes.
12.5 Flowers supplied by Joli Creations & Designs are for decorative purposes only, and are not for human consumption.
12.6 When fresh flowers are used for the decoration of the wedding cake, the part of the cake which have been in contact
with flowers must not be eaten.

13. Complaint Policy

13.1 Any complaints about goods and services provided by Joli Creations & Designs must be made upon receipt of
flowers/decor on your wedding day, prior to the ceremony commencement. After this time, it is deemed that the Client is
satisfied with all aspects of the good as delivered/designed and created.
13.2 Joli Creations & Designs designs Client’s flowers for use on his day: flowers are perishable items, and will begin to
slowly decline naturally once removed from water. Therefore, Joli Creations & Designs cannot guarantee the longevity of
flowers after the event day, and cannot take any responsibility for this.

14. Copyrights & Advertising

14.1 Images provided to the Client by Joli Creations & Designs are protected by copyright and are the property of Joli
Creations & Designs; they may not be used, copied, published or distributed without the express consent of Joli Creations
& Designs.
14.2 Photos of flower arrangements and/or decorations by Joli Creations & Designs must indicate – if they will be in any
way whatsoever published – the following credit: Wedding/Event Designed & Styled by Joli.co.za

14.3 The Client authorizes Joli Creations & Designs to publish photos of the event/wedding, and the client will send these
photos – in high resolution size – as soon as the client received them from the photographer. However we also respect
our client’s privacy, so if you explicitly do not want images of yourself or guests in these images please don’t hesitate to
let us know.
14.4 Joli Creations & Designs will credit the wedding photographer, venue and client name unless otherwise agreed.

14.5 All design sketches provided by Joli Creations are subject to Copyright law and cannot be shown to, copied or used
by any other florist or decorator. All designs are the property of Joli Creations & Designs and if the Client chooses not to
use Joli Creations & Designs to provide his wedding decoration, all design sketches must be returned without being
copied.

15. Limitations of liability

15.1 Except where Joli Creations & Designs is in breach of a guarantee in terms of the law, the Client is entering into this
contract acknowledges that in all other circumstances whatsoever Joli Creations & Designs shall not be liable for direct or
consequential damage, loss or expense whatsoever and howsoever arising (whether in contact or in tort) including that
resulting from the negligence of Joli Creations & Designs or arising by operation of law and whether suffered by the Client
and/or third party for any amount that exceeds the amount actually paid by the Client to Joli Creations & Designs
pursuant to this contract.
15.2 Joli Creations & Designs will not be liable or responsible for any failure to perform or delay in performance of any of
our obligations that is caused by events outside our reasonable control.
15.3 Events outside our reasonable control include any act, event, non-happening, omission or accident beyond our
reasonable control and include in particular (without limitation) the following:
• Strikes, lock-outs or other industrial action
• Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or
threat or preparation for war.
• Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
• Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private
transport.
• Impossibility of the use of public or private telecommunications networks.
• The acts, decrees, legislation, regulations or restrictions of any government.
• Unusual weather conditions
15.4 The performance of the Company under any Contract is deemed to be suspended for the period that the event which
is outside of its control continues, and Joli Creations & Designs will have an extension of time for performance for the
duration of that period.
15.5 Joli Creations & Designs will not accept any responsibility should flower selection for the Client fail to be delivered
by the wholesalers due to lack of availability. In this instance the client will be notified.
15.6 Joli Creations & Designs will place items at the ceremony venue or the reception venue in order to minimise risks
and hazards; the Company reserves the right to relocate items in the case that the weather is inclement and could cause a
hazard to wedding guests or damage to hired items.
15.7 Joli Creations & Designs will only be responsible for décor and flowers provided by the company and do not take any
responsibility towards items/décor or flowers provided by other providers/companies.

16. Venue Rules & Regulations

16.1 It’s the client’s responsibility to obtain all necessary contracts, rules and regulations from chosen venue. Joli
Creations and Design will not be held liable due to any misconduct or breech of any rules and regulations provided to the
client by the venue. All such documents must be provided to Joli Creations and Designs to make us aware of any such
rules and regulations.
16.2 All Rules & Regulation form venues must be signed by the client and be overviewed by Joli Creation & Designs.
16.3 Any fines due do not operate in the terms of the rules and regulation will be paid by the client and Joli Creations &
Design will not be held liable if all necessary documents were not provided by the client.
