Re: Complaint against PT Nubika Jaya

With reference to the complaint lodged by the NGO Masyarakat Peduli Lingkungan Hidup Labusel (MPLH
Labusel) on 9 June 2016, alleging that PT Nubika Jaya is polluting the Baba river.

The RSPO Complaints Panel has deliberated on the matter and takes note of the following:

a. The field verification conducted by the Provincial Environmental Office (BLH) of North Sumatra,
and conveyed by the letter No.539/BLH-SU/BPL-KL/2015, PT Nubika Jaya has made significant
progress and improvement to their waste management operations and have ceased any activity
that contributes to any river pollution.
b. An action plan was agreed and signed by both parties (PT Nubika Jaya and MPLH Labusel) on 12
August 2015 to address all the issues in the complaint.
c. Based on the progress report submitted to RSPO on 30 January 2016 by PT Nubika Jaya; all the
major action points have been implemented and the company now enjoys better communication
and engagement with the local communities.

Therefore, the RSPO Complaints Panel is satisfied that PT Nubika Jaya has undertaken positive actions
to resolve this complaint and is recommending that this complaint be closed. Thank you.
