Accused, ELMER MENDOZA unto this Honorable Court, respectfully applies for
Probation under Presidential Decree No. 968, as amended, and further declares:

1. That he is of legal age and a resident of Brgy. Biñohon, Malabon City, Negros
Oriental;
2. That he has been charged for the crime of Viol. Of R.a. 9287 and was
convicted to lesser offense and sentence to 90 days imprisonment;
3. That the crime for which he was convicted is not an offense against the security
of the state or public order;
4. That he had not previously been convicted by final judgment of any offense
punished by imprisonment of not less than one (1) month and one (1) day and/or
a fine of not less than Two (2) Hundred Pesos (P200.00) and;
5. That he has not been on Probation under the provision of P.D. 968, as amended.
