APPLICATION FOR PROBATION

ACCUSED, ELVIE GONZALES, through the undersigned counsel

and unto this Honorable Court, most respectfully applies for probation
under the provisions of Presidential Decree No. 968 as amended and
states that:

1. That the accused, ELVIE GONZALES, is a Filipino, of legal age,

single, and a resident of Dumlog, City of Talisay, Cebu, Philippines;

2. That on December 06, 2023, the ACCUSED was convicted for Light
Oral Defamation under the Revised Penal Code, sentencing the
accused to serve the penalty of 10days to 20 days maximum and to
pay a fine of 10,000 as Moral Damages.

3. That the crime for which he had been convicted is not an offense
against the security of the state or public order;

4. That the Accused had not been previously convicted by final

judgment of any offense punishable by imprisonment of not less than
one month and one day and/or fine of not less than two hundred
pesos;

5. That the Accused had not been once placed on probation under the
provisions of Presidential Decree No. 968, otherwise known as the
Probation Law of 1976, as amended;

6. Accused has all the qualifications and none of the disqualifications to

avail of the benefits of the Probation Law.

WHEREFORE, premises considered, it is most respectfully prayed of

this Honorable Court that the Application for Probation be referred to the
Parole and Probation Officer of City of Talisay, Cebu, for the requisite post-
sentence investigation and thereafter, the application for probation be
approved.

Other reliefs just and equitable in the premises are likewise sought.
