APPLICATION FOR PROBATION

The accused, Erick Malijan y Sentileces,  by and through the


undersigned counsel and unto this Honorable Court, most respectfully
applies for probation under the provisions of Presidential Decree No.
968 as amended and states that:

1. In its Decision dated 29 October 2021, read in open court last


11 November 2021 in the presence of the accused, this
Honorable Court ruled as follows:

“WHEREFORE, in view of the foregoing, accused ERIC


MALIJAN y Santelisis (sic) is found GUILTY beyond
reasonable doubt of the crime of Slight Physical Injuries and is
meted to suffer a straight imprisonment of ten (10) days of
arresto menor. He is likewise ordered to PAY private
complainant Gilbert Solares the amount of Php3,000.00 as
moral damages.

SO ORDERED.”

2. The crime for which the accused was convicted is not an


offense against national security or public order;

3. Accused has not been previously convicted by final judgment of


any offense punishable by imprisonment of not less than one
month and one day and/or fine of not less than two hundred
pesos;
4. Accused has not been once placed on probation under the
provisions of Presidential Decree No. 968, otherwise known as
the Probation Law of 1976, as amended; 

5. Accused has all the qualifications and none of the


disqualifications to avail of the benefits of the Probation Law;
and

6. A copy of the online deposit confirmation for the payment of the


total fine of Three Thousand Pesos (Php3,000.00) to private
complainant Gilbert Solares’ counsel, Atty. Julio Narag, who
undertook to remit the same to his client, is attached hereto.

PRAYER
         WHEREFORE, premises considered, it is most respectfully
prayed of this Honorable Court that this Application for Probation be
referred to the Antipolo City Parole and Probation Office for the
requisite post-sentence investigation and thereafter, the application for
probation be approved.
 
  The accused likewise prays for such other reliefs as may be
deemed just and equitable under the premises.
