APPLICATION FOR PROBATION

Accused, assisted by the PUBLIC ATTORNEY’S OFFICE, unto this Honorable Court,
most respectfully apply for probation under the provisions of Presidential Decree 968, as
amended and avers that:

1. Accused is 35 years of age and a resident of Upper Agnawe, Guba, Cebu City;

2. She has been convicted of 2 counts of violation of Section 12, Article II of RA

9165 and sentenced to serve a maximum term of imprisonment of not more than six
(6) years;
3. Accused did not appeal from nor move for reconsideration of the decision/order;
4. The crime for which she had been convicted of is not an offense against the security
of the state or any crime against national security of the public order;
5. She has not been previously convicted by final judgment of any offense punished
by imprisonment of “not more than six (6) months and one (1) day” and/or fine of
“more than One Thousand Pesos (PhP 1000.00);
6. She has not availed of the benefits of probation under the provisions of Presidential
Decree 968, as amended.
