Canceran vs.

People
No less than the Constitution guarantees the right of every person accused in a
criminal prosecution to be informed of the nature and cause of accusation against
him. In this connection, an accused cannot be convicted of a higher offense than
that with which he was charged in the complaint or information and on which he
was tried.

In the present case, the accused was charged with frustrated theft. Although the
evidence presented during the trial proved the crime of consummated theft, the
accused could be convicted of attempted theft only pursuant to his right to be
informed and to the ruling in Valenzuela vs. People that there is no crime of
