AFFIDAVIT OF ADVERSE CLAIM

KNOW ALL MEN BY THESE PRESENTS:

That I, ANTONIO L. MALENAB, of legal age, Filipino, married and a resident of Centro Solana,
Cagayan married and a resident of Centro, Solana, Cagayan, after having been duly sworn to in
accordance with the law depose and say, that;

1. I am a purchaser for value and in good faith of a “Half of a portion of a parcel of land
designated as Lot No. 161-F(Remaining Portion) of the APPROVED Subdivision Plan Psd-
201-020429, CAD-293 ; bounded on the east by Lot No. 161-F2 along line 1-2, measuring
approximately 16.77m. more or less, bearing S10d32’W; on the south by Osmena St. along
line 2-3 measuring 21.31m., bearing N81d34’W; on the west by Lot 159 along line 3-4,
measuring 17.42m., bearing N9d06’E; and on the north by Lot 161-E along line 4-1,
measuring 21.51m. bearing S80d41’E,… (Being a portion of Lot No. 161- F, of the Cadastral
Survey of Solana, Cadastral Case No. N-13, LRC Cadastral Record No. N-003), containing
an area of THREE HUNDRED SIXTY FIVE (365.92) square meters more or less.”

2. Said lot was acquired by virtue of a “DEED OF ABSOLUTE SALE OF A PORTION OF

PARCEL OF A REGISTERED LAND” and “WAIVER OF RIGHTS” executed by HENRY P.
CANAPI as owner and Attorney–in-Fact, of Blk-L15, ACM Subd., Sanja Mayor, Pagrai
Mayamot, Antipolo, Rizal, one of surviving heirs of INOCENCIO CANAPI (Deceased):

3. I am executing this affidavit in my own free will and volition, to attest to the fact of the
foregoing and invoke my rights thereof and consequently cause the entry and registration of
this claim to the REGISTER OF DEEDS OF CAGAYAN.

IN WITNESS WHEREOF, I have hereunto set my hand this 16th day of July 2014 at Tuguegarao
City, Cagayan.
